NOTICE OF FINALIZATION
SUBSEQUENT MITIGATED NEGATIVE DECLARATION
LEVEL (3) COMMUNICATIONS INFRASTRUCTURE PROJECT

 BACKGROUND

In Decision No. 98-03-028, issued March 28, 1998, the California Public Utilities Commission (CPUC) granted Level (3) Communications, LLC (Level (3)), a CPCN to provide services to the public as a facilities-based, competitive local exchange carrier.  CPUC’s decision allows Level (3) to construct underground innerduct and cable installation and support facilities within existing utility Right-of-Ways (ROWs).  In accordance with the environmental mitigation measures specified in CPUC’s Negative Declaration IX for the Project, a Petition to Modify (or “Application for Modification of”) the CPCN must be filed to obtain approvals for activities outside of existing utility ROWs.  To address CPUC’s requirements for proposed off-ROW work, Level (3) prepared and submitted a Final Proponent’s Environmental Assessment (PEA) on January 24, 2000, as part of its filing of an Application for Modification of its CPCN.  The Application for Modification involves the construction and operation of twenty-one (21) Project elements that would involve off-ROW activities.  These elements and their locations are listed below by County. 

Finalization of the Subsequent Mitigated Negative Declaration and Initial Study

In response to Level (3)’s Application for Modification of its CPCN, the CPCN prepared a Subsequent Mitigated Negative Declaration (SMND) and Initial Study to the above-referenced Negative Declaration IX.  The SMND and its Initial Study describe the proposed Project modifications (off-ROW elements) and their potential environmental effects.  Based on these documents, it has been determined that the proposed modifications will not have any effects on the environment that cannot be mitigated to a level of less-than-significant. 

The SMND and Initial Study were made available for public and agency review and comment between April 10, 2000 and May 19, 2000.  The documents were made available on the Internet and additionally were transmitted to the locations referenced in the table below.  In total, eleven (11) comment letters were received, ten (10) of which were received by state and local agencies, and one (1) of which was received from the public. 

Following closure of the public review period, responses to all comments received on the documents were completed, and modifications to the Initial Study and SMND were undertaken, as appropriate, to reflect these comments.

Volume I represents the Final SMND and Initial Study necessary for the Commission to consider approval of the 21 proposed off-ROW Project elements.  It includes: the comments received on the April 10, 2000 SMND and Initial Study; the CPUC’s responses to these comments; modifications to the text of the April 10, 2000 SMND, where appropriate, to address comments; and, a Mitigation Monitoring Plan for Commission adoption if the Final SMND and Initial Study are approved. 

Volume II is the original SMND and Initial Study that were made available for public and agency review on April 10, 2000.  It includes: a Project overview and Master Initial Study Checklist for all of the proposed off-ROW elements; and, the 21 site-specific Initial Study Checklists for each of the proposed elements. 

Together, Volumes I and II represent the Final SMND and Initial Study for the proposed off-ROW elements. They are intended to be used in conjunction with the each other for site-specific detail and general reference.
