A94-09-025 - Related matter. Grants a joint motion for approval of a settlement agreement attached as Appendix A as amended, between the Commission's enforcement staff and respondents Heartline Communications, Inc. and Total National Telecommunications, Inc. (TNT). Under terms of the settlement, Heartline and TNT are suspended from retail long distance service in California for 40 months, and they are required to offer some $600,000 in refunds in the form of $20 checks for each of the 32,000 customers who had complained that their long distance service was switched without their consent. The settlement establishes a claims process for customers who claim losses in excess of $20, and it requires Heartline/TNT to pay $35,000 into the state's General Fund to resolve an allegation that respondents' attorneys withheld information during the investigation. HLEG-6 AB 2597 (Alby) as amended on April 24, 1996 and as proposed to be amended. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions.
