C96-02-002 Compaq Computer Corporation and Intel Corporation vs. Pacific Bell, for unjust and unreasonable rates and charges, and practices, and inadequate service for its Integrated Services Digital Network service. On January 16, 1997, Cynthia Walker, Regulatory Manager for the California Cable Television Association (CCTA), spoke with Tim Sullivan, advisor for Cmmr. Duque in San Francisco. Walker stated that the rate proposal contained in the draft order was inconsistent with the costing and pricing approach taken in OANAD. Walker urged the Commission to add language to the draft order stating that the Commission will review ISDN rates in the OANAD proceeding. Walker stated that the order provisioning requirements contained in the draft order create costs that are not considered in the cost development of ISDN service. On January 17, 1996, John Gueldner, Vice President - Regulatory for Pacific Bell (PacBell), met with Cmmr. Neeper in San Francisco. Also present were: Fassil Fenikile, advisor to Cmmr. Neeper; and Robert Lee, President of Business Communications Services, and Robert Mazique, Senior Counsel for Pacific Telesis Group, for PacBell. Written material (attached to the notice) was used. PacBell stated that the draft decision released 1/13/97 contained significant revisions and that a vote on the matter should be delayed until the parties have an opportunity to comment. PacBell noted that it wants to market and promote the ISDN services, however, at present it cannot cover its costs. PacBell added that the proposed decision imposes costs which are not reflected in the cost study. PacBell explained that since ISDN service is usually ordered by customers as a second line for computer communications, rate shock is not an issue and the full price increase in the proposed decision leaves PacBell's prices below TSLRIC price floors, contrary to the Commission's requirements. PacBell pointed out that it based the proposed prices on the TSLRIC cost study which the Commission accepted in the open access network and development proceeding.
