Gueldner stated that the $5.00 increase granted in the proposed decision leaves the rates for ISDN below the price floor. Gueldner stated that if PacBell is required to resell ISDN below the price floors, there will be little likelihood of facilities-based competition. Geuldner stated that PacBell's proposal of $8.00 still leaves ISDN as one of the lowest in the country. On February 13, 1997, Phyllis Huckabee, Director, State Regulatory Relations for Southern California Gas Company (SoCalGas), met individually with Cmmrs. Conlon, Bilas, Neeper, and Knight in San Francisco. Warren I. Mitchell, President of SoCalGas, and Martin J. Collette, Rate Design Manager for SoCalGas were also present at each meeting. James Hendry, advisor for Cmmr. Conlon, Jean Vieth, advisor for Cmmr. Bilas, and Dorothy Duda, advisor for Cmmr. Knight, were present at those meetings involving their respective Commissioner. Mitchell stated that the proposed decision in the BCAP whittles away at prior Commission policies and decisions, including Long-Run Marginal Cost (LRMC), Capacity Brokering, Storage, and the Global Settlement. Mitchell stated that the proposed decision increases noncore rates by 20 percent and reduces core rates by approximately 4 percent, despite relatively stable revenue requirements. Mitchell stated that the replacement cost adder, by definition, is not part of LRMC methodology, and that application of the "New Customer Only" method for calculating marginal customer costs after the expiration of the Global Settlement should not be decided in this BCAP. Mitchell stated that the core should continue to pay its share of pipeline capacity and storage cots, as determined in previous Commission decisions dealing with those issues. Mitchell stated that the Commission should also continue movement toward cost-based rates, gradually increasing the customer charge to reflect actual costs and continuing deaveraging of core rates that were begun in the last BCAP. Collette stated that the Transwestern and E; Paso settlements represented a substantial savings in core capacity costs and that the core, as a major holder of capacity, is a large beneficiary of those settlements sand should pay its share of the risk sharing surcharges associated with the settlements. Collette stated that the changes to LRMC adopted in Pacific Gas and Electric Company's (PG&E) BCAP were specific to PG&E's circumstances and should not be applied to SoCalGas. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions.
