Jenkins-Stark stated that the Gas Accord settlement is the accomplishment of over a year of difficult negotiations. The parties stated that only TURN, the State of New Mexico, and the California Department of General Services actively oppose the Gas Accord. Jenkins-Stark stated that a key difference between the Gas Accord and the opposing proposal is that the Gas Accord establishes a gas industry structure that will provide stable gas prices through the year 2002 as a basis for implementing electric industry restructuring. McCrea stated that another key feature of the Gas Accord is that it provides rate certainty. McCrea stated that PG&E is willing to ensure rate certainty, plus assume the transmission cost recovery risk for all throughput. Jenkins-Stark stated that the Gas Accord is consistent with Commission policy, not only because it resolves issues through a settlement, but because it proposes to unbundle transmission and distribution services, and eliminate balancing accounts. Frank stated that under the Gas Accord, core customers retain vintage-pricing on the northern supply path, while noncore customers have agreed to a uniform price for lines 400 and 401. Pocta stated that this rate is not a rolled-in rate to end-users because the rates are unbundled and there is an expectation that marketers will hold the capacity rather than end-users. Leslie stated that the Gas Accord also rationalizes the backbone transmission system. Elsesser stated that under the current system, market players are frustrated with the manipulation of capacity upstream. Elsesser stated that Amoco produces significant quantities of New Mexico gas, and that they support the lower line 300 rate proposed by the Accord. Jenkins-Stark stated that Enron, Transwestern, and California producers also support the structure proposed in the Accord. Leslie stated that under the opposing proposal, it would be difficult, if not impossible, for a supplier or marketer to offer a customer a fixed price contract over a six-month or one-year period. The parties stated that PG&E and core aggregators have worked to remove barriers to serve the core market in order to allow customers more choice and competitive opportunities. Petrochko stated that the unbundling of interstate demand charges from core transportation rates will provide core customers with access to additional competitive opportunities that currently are available to noncore customers. Hughes stated that the proposal would shift cost from core to noncore customers, thus increasing the cost paid by Southern California gas-fired electric generators. Huhges stated that the PD is erroneous because it gives no weight to the evidence presented by Edison and others on the irreversible harm to electric consumers that will occur if costs are shifted. Hughes stated that the PD, if adopted, would increase the utility electric generation rate by 15% in 1997 and 50% for the period 1/98 through 7/99 relative to the current cost allocation methodology that SoCalGas has sought to maintain. Hughes stated that approval of a rate freeze in the recent electric restructuring legislation does not protect consumers from incurring higher electricity costs due to the proposed core to noncore cost shifts advanced in the PD. Cushnie stated that the PD is based on a false premise that SoCalGas' noncore customers receive most of the capacity step-down benefits. McCrea stated that noncore customers are not opposing the filing because PG&E and the aggregators have assumed the responsibility for any stranded costs and will not shift those costs to noncore customers, therefore, no cost shifting will take place as a result of the unbundling proposal.
