On March 25, 1997, Diane Fellman, regulatory counsel for the Diablo Canyon Independent Safety Committee (Committee), participated in all-party meeting with Cmmrs. Duque and Knight in San Francisco. Also present were: Michelle Cooke, advisor to Cmmr. Duque; Dorothy Duda and Robert Lane, advisors to Cmmr. Knight; Jean Vieth, advisor to Cmmr. Bilas; James Hendry, advisor to Cmmr. Conlon; and Robert Wellington, counsel, and William Kastenberg, member of the Committee. A list of other attendees is attached to the notice. The Committee stated that the proposed decision (PD), in adopting PG&E's uncontroverted position erred in not specifically mentioning the Committee. The Committee also stated, that, combining this with elimination of the underlying Diablo settlement that created the Committee, PG&E is not suggesting that it may be the Commission's intent not to continue the Committee. The Committee argued that the PD inadvertently failed to mention it when it adopted the other related elements of PG&E's application and that in its comments on the PD, PG&E does not object to funding the Committee in base rates, until the end of the transition period. The Committee noted that the California Energy Commission authorized Fellman to speak on its behalf at this meeting in support of the Committee. Smith stated that in 1996 PG&E filed a SONGS-like ratemaking proposal, given up $4 billion (NPV) in CTC recovery relative to the 1994 modified settlement, and, beginning in January 1997, PG&E cut its dividend 39%. Warner stated that the proposed decision (PD) deviates significantly from SONGS-like ratemaking treatment. Warner stated that the imposition of the $100 million design penalty should be eliminated because there is not evidence or support for the disallowance in the record, and PG&E never admitted to any imprudence in the 1988 Diablo Canyon proceeding. Warner noted that the restructuring rate settlement referenced in AB 1890 requires a verification audit, but exempts Diablo Canyon sunk costs from a prudence review. Warner asserted that the PD should reflect SONGS-like treatment by including materials and supplies in sunk costs, and should also include nuclear fuel inventory, subject to a true-up, if necessary. Warner stated further that the ICIP pricing should balance risk and reward comparable to SONGS, and the decision should be changed to require no annual rate cases and reasonableness reviews. Warner also asked the Commission to clarify that Diablo Canyon remain a must-take resource, and that the decision be effective 1/1/97, to match PG&E's depreciation of Diablo Canyon. ORA stated, referring to the proposed decision (PD) on sunk costs, that the $65 million disallowance is exceedingly conservative, but fairly based on the Commission's funding of fact in the Diablo Canyon settlement decision. ORA also stated that the PD allows PG&E to recover 100% of its operating costs. ORA noted that, in contrast, PG&E's requested fixed ICIP prices would give it the incentive to generate large amounts of uneconomic power. ORA asserted that the Commission adopted a trigger mechanism that eliminated the need for reasonable reviews for Palo Verde operating costs, and ORA would support such a mechanism for Diablo Canyon. ORA stated that PG&E's stock price rose after the PD was issued, while utility stocks declined in general, demonstrating that the financial community sees the PD as favorable to PG&E. ORA asserted that the it is unnecessary to apply the SONGS ICIP mechanism to Diablo Canyon because the Commission eliminated the Biennial Resource Plan Update proceeding. ORA stated further that the PD would guarantee PG&E all of its sunk costs, and give it back the $1.2 billion write-off, with interest, less just $65 million. ORA also noted that PG&E's analysis of having earned less than under traditional ratemaking assumes no write-off of the $1.2 billion required under the settlement. ORA pointed out that the PD is consistent with requirements of AB 1890 and the Commission's restructuring decisions. Bergum stated that the DDTP Administrative Committee seeks authority to increase the CRS reimbursement rate to provide incentive for other CRS providers. On March 25, 1997, Phyllis Huckabee, Director of State Regulatory Affairs for Southern California Gas Company (SoCalGas), met with Cmmr. Kinght. Also present were: Robert Lane, advisor to Cmmr. Knight; and Rick Morrow, Vice President, Commercial and Industrial Services, and Lad Lorenz, Director, Capacity and Operational Planning, for SoCalGas. Morrow stated that SoCalGas' fixed-price option proposal id designed to provide a tariffed stable pricing that is no longer available to customers from the utility since the adoption of monthly pricing. Morrow explained that the option's primary purpose is to address unmet customer needs and that it is appropriate for the utility to offer an option similar to the stable pricing. Morrow stated that SoCalGas continues to support the core aggregation transportation (CAT) program and that this proposal would not negatively impact the CAT program. Would require that the Commission submit a report to the Legislature by July 1, 1997 that recommends an approach to financing existing low- income public policy prograns that does not create competitive imbalance between Commission- regulated natural gas providers and others. Commission voted 4-0 to approve recommendation to support the bill. Commissioner Fessler necessarily absent. HLEG-4 AB 2589 (Battin) as amended on April 17, 1996. Would require approval by April 1, 1997, of an experimental rate design, in Climatic Zone 15, which may diverge from the inverted rate structure mandated by Section 739 of the Public Utilities Code. Commission voted 3-1 to support recommendation to take a neutral position on the bill if funding to implement is provided. Commissioner Neeper dissented. Commissioner Fessler necessarily absent. HLEG-6 AB 2597 (Alby) as amended on April 24, 1996 and as proposed to be amended. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions.
