Nelson stated that if the Commission adopts a policy which denies one-way paging carriers' rights to compensation it will in effect be picking winners and losers as multi-service providers are able to receive termination compensation, as their paging traffic is indistinguishable from voice or other messaging traffic. Cook stated that unstayed parts of the Federal Communications Commission's (FCC) First Report and Order require that termination compensation be paid to paging carriers and that this Commission is without jurisdiction to overrule the FCC's interpretation of the Communications Act. Cook pointed out that Pacific is paying and will continue to pay termination compensation to cellular, PCS, and competitive local exchange carriers which terminate land to pager calls. Cook also noted Pacific's admission that it avoids costs of .5 cents for each 20 second land to pager call terminated by Cook from Pacific. Stachiw stated that the Act did not differentiate between types of traffic or the content of traffic. Stachiw stated that the term "reciprocity" has been defined by the FCC to mean reciprocity of obligation not traffic. Nelson stated that paging carriers, if denied the right to compensation for termination of traffic, would be forced to consider becoming multi-service providers or CLECs in order to obtain compensation for termination of traffic. On May 12, 1997, Claudine Swartz, Regulatory Analyst of Southern California Gas Company (SoCal), met with James Hendry, advisor to Cmmr. Conlon, in San Francisco. Also present were: Mark Pocta, Program and Project Supervisor, and Don Lafrenz, Senior Utilities Engineer for the Office of Ratepayer Advocates (ORA); and James Harrigan, SoCal's Director of Gas Acquisition. Swartz stated that SoCal and ORA followed the appropriate procedure for extending and modifying the gas cost incentive mechanism (GCIM), as envisioned in D94-03-076, and noted that all parties, both in A96-06-029 and A93-10-034, were appropriately noticed. Pocta and Lafrenz noted that the motion filed with the stipulation and agreement is comparable to a petition for modification. Pocta stated that no material issues of fact remain and that it is inappropriate to schedule hearings. Harrigan stated that recent conversations with the protesting parties have raised no additional issues. Harrigan also noted that utility gas sales to affiliates will be addressed in I97-04-012/R97-04-011. Swartz encouraged the Commission to adopt the stipulation and agreement as written, reflecting the modification proposed for the GCIM year three and redacted issues. Poole expressed the disadvantageous position the Southwest producers would be placed in if the gas accord settlement (GAS) were adopted, especially with the treatment of Line 300. Poole explained that the effort of the Commission in developing a gas strategy for California would be hamstrung by the GAS for a period of 5 years.
