On July 9, 1997, Janice Grau, attorney representing the Commission's Office of Ratepayer Advocates (ORA), met with Dorothy Duda, advisor for Cmmr. Duque, in San Francisco. Brian Chang, project manager for ORA, was also present. ORA stated that it supported the proposed decision (PD) over the revised proposed decision and the alternate order. ORA stated that it is opposed to the limited facilities-based authority in Pacific Bell's (PacBell) service territory provided to PBCOM in both the revised proposed decision and the alternate. ORA stated that PacBell should continue with its existing equal access and nondiscriminatory obligations and should fully respond to the customer's inquiries regarding local service on incoming calls before marketing of PBCOM's services, if the alternate's sequencing/script procedure is adopted. ORA stated that PacBell should only have access to it customers' CPNI for joint marketing of PBCOM's services, if such access is nondiscriminatory. Conlon, in San Francisco. Jacobsen stated that PBCOM supports the alternate proposed decision. Jacobsen further stated that PBCOM will not divert incremental intraLATA revenues away from Pacific Bell (PacBell); a certain portion of PacBell's intraLATA revenues are at risk because PacBell cannot provide a bundle of intraLATA and interLATA services. Jacobsen stated that PBCOM will be one of many companies competing for those customers who want to purchase bundles of these services. Jacobsen asserted that PacBell and PBCOM would not oppose a rigorous Commission monitoring requirement whereby the Commission could detect if a disproportionately large portion of PacBell's intraLATA losses are attributable to PBCOM. On June 9, 1997, Andrew Rea, Vice President of Pacific Enterprises Energy Services (Pacific), spoke with Cmmr. Duque. Rea stated that the Southern California Gas Company (SoCal) supported the alternate pages of Cmmr. Conlon, in comparison to the provisions on productivity and earnings sharing in the ALJ's revised proposed decision. Rea stated that the alternate represents a compromise of positions that all parties should accept. Rea also stated that operation under the terms of the alternate would present a challenge for SoCal, but that it was the best available regulatory option at this time. On July 9, 1997, William C. Harrelson, Senior Counsel for MCI Telecommunications Corporation (MCI), met with Cmmr. Duque in San Francisco. Also present were: Tim Sullivan, advisor for Cmmr. Duque; Elisa Jackson, Cmmr. Duque's Legal intern; and Robert Kargoll, Regulatory Director for AT&T. Harrelson stated that that the alternate decision violates the requirements of both the Telecommunications Act of 1996 and the Costa Bill, in particular as to how the alternate would treat CPNI issues. Harrelson stated that the separate sales force requirement was the only practical way to enforce strict nondiscrimination regarding access to information and to prevent cross-subsidy, without ongoing monitoring by the Commission and numerous compliance disputes being brought by competitors. Kargoll concurred in Harrleson's comments and stated that AT&T and MCI generally supported the Phase II Local Competition Rulemaking Order requiring that additional services be subject to resale. On July 9, 1997, James T. Quinn, counsel for the Commission's Utilities Safety Branch (USB), met with James Hendry, advisor for Cmmr. Conlon, in San Francisco. Julian Ajello, a supervisory engineer for USB, was also present. Raffy Stepanian, a USB associate utilities engineer, participated via telephone. USB stated that Pacific Gas and Electric (PG&E) had received nearly half a billion dollars for the purpose of improving system reliability, f which tree trimming is an element. USB stated that PG&E's claim that tree trimmers require 18 months of training and therefore there is great difficulty finding sufficient workers to meet a two-year implementation requirement is not well grounded. USB stated that requiring a minimum 18-inch clearance should not be a problem for PG&E. USB stated that more than half of PG&E's trees are within areas of Department of Forestry jurisdiction where the clearance requirements have been more stringent than 18 inches. USB stated that there are alternatives to cutting down large trees, namely, using tree wire or extending the line away from the trees. USB Contact: James T. AUGMENTATION REQUIRED. On July 9, 1997, Avlin Odviar, of the Commission's Rail Safety and Carriers Division (CPUC), met with Cmmr. Duque in San Francisco. Michelle Cooke, advisor for Cmmr. Duque, and James T. Quinn, counsel for CPUC, were also present. A written outline of subjects and a map of the proposed Andersen Drive grade crossing were distributed. Odviar stated that 11-degree, skewed nature of the proposed grade crossing presented safety problems. Odviar stated that CPUC has sought a reliable plan for financing a grade separation structure from the City of San Rafael, but what the city presented was not sufficient. Quinn stated that the proposed decision (PD) failed to discuss major issues. Quinn stated that the PD did not address the growing interest in implementing a new transportation plan that has been endorsed by Marin and Sonoma leaders. Quinn stated that the PD did not describe or address the Redevelopment Agency financing plan whereby the City had maintained that it would fund a grade separation if regular rail service were to resume, and state and federal funds were not available.
