Florio stated that Canadian shippers would continue to deliver gas to the California market as long as it provided netbacks equivalent to those available in other markets, and that transportation costs to those other markets would likely not represent sunk costs from the supplier perspective. Florio stated that PG&E would tend to extract economic rents from transportation facilities of limited capacity prior to PGT expansion shippers receiving such rents, because PG&E acted as a single entity in pricing Line 401 while multiple shippers hold and attempt to sell firm capacity on PGT. Florio stated that a pure auction would represent one potentially reasonable approach to allocating access to Line 400, but that the joint recommendation sponsors had not proposed that option due to concerns regarding potential gaming of deliveries into Lines 400 and 401 and the allocation of the related revenues between PG&E and its noncore customers. Florio stated that since PG&E and El Paso will be the dominant players in the interstate capacity market after 1/1/98, it is clearly in California's best interest to create a structure that encourages those companies to compete with each other on the basis of price to the maximum extent possible. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions.
