Grants a joint motion for approval of a settlement agreement attached as Appendix A as amended, between the Commission's enforcement staff and respondents Heartline Communications, Inc. and Total National Telecommunications, Inc. (TNT). Under terms of the settlement, Heartline and TNT are suspended from retail long distance service in California for 40 months, and they are required to offer some $600,000 in refunds in the form of $20 checks for each of the 32,000 customers who had complained that their long distance service was switched without their consent. The settlement establishes a claims process for customers who claim losses in excess of $20, and it requires Heartline/TNT to pay $35,000 into the state's General Fund to resolve an allegation that respondents' attorneys withheld information during the investigation. On December 16, 1996, John Gueldner, Vice President Regulatory for Pacific Bell, had copies of Pacific Bell's consolidated comments (filed with the Commission) on the arbitrator's report and MCI agreement delivered to Cmmr. Also present were: John Scadding and Lester Wong, advisors to Cmmr. Conlon; and Mary Vanderpan, Regulatory Vice President of Pacific Bell. Written materials (attached to the notice) were used. Gueldner stated that MCI agreement filed on 12/10/96 contains many open issues and needs to be consistent with the AT&T agreement previously filed. Gueldner also noted that although Pacific Bell did not prevail on all of its issues in the AT&T agreement, it is a fair outcome and should be used a sa model for the final MCI agreement. Gueldner stated that Pacific Bell cannot provide unique terms on all of the numerous issues raised by each individual competitive local carrier. Gueldner asserted that the decision approving the MCI agreement should set recurring and non- recurring prices to cover open access network and development costs. Gueldner pointed out that the Commission should clearly define MCI's obligation to pay for unique requests. Gueldner stated that MCI should pay costs of requested unbundled elements beyond the standard list and also pay costs associated with its requested higher-than- parity service levels. AUGMENTATION REQUIRED. Mary Vanderpan, Regulatory Vice President of Pacific Bell, met with Cmmr. Conlon in San Francisco. Also present were: John Scadding and Lester Wong, advisors to Cmmr. Conlon; and John Gueldner, Vice President of Pacific Bell. Gueldner described an electronic order system that Pacific Bell has designed to specifications of local competitors. Gueldner stated that other competitive local carriers use this electronic order system to input their order. Gueldner explained that MCI refuses to use this electronic system and instead insists on shipping Pacific Bell thousands of paper orders. Gueldner pointed out that as a result, Pacific Bell employees are dedicated each day to the task of processing MCI's orders by hand, fixing MCI's errors and then inputing those orders into the electronic system. Gueldner added that Pacific Bell is highly motivated to assure that local competition proceeds quickly and effectively. Gueldner indicated that while Pacific Bell has a strong case, it will work with MCI to address these issues. CCTA Contact: Maria Politzer filed Tel: (510) 428-2225 12/19/96 I94-06-012 Commission Order Instituting Investigation and Order to Show Cause to determine if San Diego Gas & Electric Company should be held in violation of G.O. 95; and fined for its failure to comply with PU Codes 701, 2107, 2108 and 2112 by failing to exercise reasonable tree trimming practices and procedures. On December 17, 1996, Joseph R. Kloberdanz, San Diego Gas and Electric's Regulatory Affairs Manager, spoke to Camden Collins, advisor to Cmmr. Fessler. Kloberdanz expressed concern with likely cost impacts due to the increased minimum clearances from 6 inches to 18 inches in the Commission's draft tree trim decision. Kloberdanz pointed out that the costs are estimated to increase between $1 million and $3 million per year, due to the need to increase the frequency of trim on fast-growing trees on a continuing basis to achieve the incremental clearances. Kloberdanz emphasized that the Commission's decision will increase costs upon the state's utilities during such time as the legislature has imposed a rate freeze upon the utilities. Mazique stated that the proposed decision in ISDN needed extensive work because the decision made the ISDN cost study inconsistent with the cost study approved in OANAD. Mazique urged the Commission to maintain consistency in the cost studies used in the two proceedings. Vanderpan stated that the proposed decisions changes in the cost study resulted in a higher proposed rate for business and residential ISDN. A96-04-030 San Diego Gas & Electric Company, for authority to revise its rates effective January 1, 1997, in its Biennial Cost Allocation Proceeding for an approximately $42 million decrease over presently authorized revenues. On December 17, 1996, Mark Pocta, program and project supervisor in the Office of Ratepayer Advocates (ORA), met with James Boothe, advisor to Cmmr. Fessler, in San Francisco. Pocta stated that ORA had not conducted an analysis of the cost impact of its proposal on customers that procure gas from San Diego Gas and Electric Company (SDG&E). Pocta asserted that it was ORA's expectation that the cost impact should not be substantial given that SDG&E holds interstate capacity rights below its core requirements and that SDG&E holds a substantial share of the procurement market in its service territory. Pocta explained that SDG&E has 10 MMcfd of firm interstate capacity on El Paso and 55 MMcfd on the PGT/PG&E Expansion, while SDG&E's core requirements average approximately 100 MMsfd annually. Pocta noted that, given recent market conditions, the El Paso capacity could be expected to be above the market rate but the impact on SDG&E's procurement customers should not exceed $0.02 per decatherm over market under ORA's unbundling proposal. Pocta also stated that the impact of the PGT/PG&E capacity would be more difficult to quantify and could be either positive or negative given the recent market conditions and other factors. On December 16, 1996, Joseph DeUlloa, attorney for the Office of Ratepayer Advocates (ORA), met with Cmmr. Neeper in San Francisco. Also present was David Gamson, advisor to Cmmr. Neeper. A copy of ORA's reply to San Diego Gas and Electric Company's (SDG&E) motion to establish a revenue shortfall balancing account (RSBA) was used. DeUlloa explained that the creation of a RSBA and the transfer of money from SDG&E's energy cost adjustment clause and electric revenue adjustment mechanism balancing accounts into RSBA was necessary to ensure that SDG&E's ratepayers did not pay twice for the same energy. DeUlloa urged the Commission to issue a ruling prior to the end of the year. Would require approval by April 1, 1997, of an experimental rate design, in Climatic Zone 15, which may diverge from the inverted rate structure mandated by Section 739 of the Public Utilities Code. Commission voted 3-1 to support recommendation to take a neutral position on the bill if funding to implement is provided. Commissioner Neeper dissented. Commissioner Fessler necessarily absent. HLEG-6 AB 2597 (Alby) as amended on April 24, 1996 and as proposed to be amended. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions.
