Salsbury, Executive Vice President and General Counsel for MCI Telecommunications Corporation (MCI), met with Cmmr. Knight. Also present were: Dorothy Duda, advisor to Cmmr. Knight; and James L. Lewis, Regional Executive for MCI. MCI explained that its revenues for 1996 were below the $500 million threshold provided in section 854 of the Public Utilities Code and that MCI will present detailed documentation of its revenues to the Commission. MCI also stated that it will seek an exception from requirements of section 854 pursuant to the provisions of section 853(b) of the Public Utilities Code, based on the policy reasons. MCI Contact: Dorothy Maddux filed Tel: (415) 978-1245 03/13/97 A96-03-007 Pacific Bell Communications, for a certificate of public convenience and necessity to provide InterLATA and IntraLATA telecommunications services. On March 10, 1997, Janice Grau, attorney for the Office of Ratepayer Advocates (ORA), met with Cmmr. Neeper in San Francisco. Also present were: Dr. Douglas Elfner, consultant for ORA; and Brian Chang, ORA's project manager. Written material (attached to the notice) was used. A copy of the written material was also provided for Fassil Fenikile, advisor to Cmmr. Neeper. ORA stated that the Pacific Bell Communications' (PBCOM) application can be divided into two parts: PBCOM's request for interLATA authority, which ORA does not oppose but which should be subject to safeguards; and the second part is the request for local and intraLATA toll authority. ORA explained that in the second part it has concerns in three areas: the prevention of cross- subsidization; continuing to provide information to customers in order for them to make informed choices; and the prevention of anti-competitive activities. ORA Contact: Legal receptionist filed Tel: (415) 703-1858 03/13/97 On March 10, 11 and 12, 1997, Janice Grau, attorney for the Office of Ratepayer Advocates (ORA), had four separate communications with Cmmr. Bilas, Cmmr. Knight, Cmmr. Duque, and Cmmr. Conlon in San Francisco. Also present were: Dr. Douglas Elfner, consultant for ORA; and Brian Chang, ORA's project manager. Written material (attached to the notice) was used. The first communication, of 3/10/97, with Cmmr. Bilas occurred via telephone conference call. Lester Wong, advisor to Cmmr. Bilas, also participated in the communication. At the second meeting of 3/11/97 with Cmmr. Knight also present was Dorothy Duda, advisor to Cmmr. Knight. At the third meeting of 3/12/97 with Cmmr. ORA explained that in the second part it has concerns in three areas: the prevention of cross-subsidization; continuing to provide information to customers in order for them to make informed choices; and the prevention of anti-competitive activities. ORA Contact: Legal receptionist filed Tel: (415) 703-1858 03/13/97 A96-04-038 Pacific Telesis Group, to transfer and SBC Communications Inc., to acquire control of Pacific Bell, which will occur indirectly as a result of Telesis' merger with a wholly owned subsidiary of SBC, SBC Communications (NV) Inc. On March 10, 1997, Thomas Corr, counsel for The Utility Reform Network (TURN), met with Cmmr. Conlon in San Francisco. Also present were: John Scadding and Jose Jimenez, advisors to Cmmr. Conlon; and Terry Murray of Murray & Associates, a telecommunications expert retained by TURN. Written material (attached to the notice) was used. TURN expressed the view that the proposed decision (PD) improperly interpreted section 854 of the Public Utilities Code in that the phrase "where the commission has ratemaking authority" refers to the allocation, not the calculation, of benefits under section 854. TURN also urged that the Commission erred by excluding Yellow Pages savings forecast from the benefits calculation. TURN asserted that the provisions of section 854 requiring that ratepayers shall receive "not less than 50%" of the forecasted economic benefits represents a floor, not a ceiling, on the Commission's ability to award forecasted economic benefits to ratepayers. TURN argued that the ten-year period for calculating benefits adopted in the PD fails to recognize the permanent nature of the forecasted savings. TURN, referring to the 1,000 new jobs promised by the Covenants, noted that the recent press stories about Pacific Bell's anticipated hiring in 1997 may exceed the number of job promised, even before the merger has been consummated. TURN also stated, referring to the so-called "Community Partnership", that the PD properly found that matter within the scope of PU Code section 854(c)(6), not 854(b)(2). On March 13, 1997, Beth Bowman, Fuels and Power Supply Department Manager for San Diego Gas and Electric Company (SDG&E), met with Cmmr. Knight in San Francisco. Also present were: Dorothy Duda, advisor for Cmmr. Knight; Mike Schneider, Pricing Services Manager for SDG&E; Lisa Hubbard, State Regulatory Affairs Director for SDG&E; and Mark Ward, Principal Regulatory Project Administrator for SDG&E. The following written materials (attached to the notice) were provided: 1996 BCAP Power Plant cost Comparison; Timeline of major gas industry changes; 1996 BCAP proposed decision SDG&E concerns; and SDG&E comments on the proposed decision (PD) filed on 2/24/97 and reply comments on the PD filed 3/10/97. Bowman stated that SDG&E was concerned that specific issues in the PD are not overlook and urged the Commission to consider revisions to the PD. Bowman stated that the PD represents a reversal of Commission policy. Bowman stated that the PD would produce an inequity in SDG&E's UEG rate as compared to UEG rates on the Southern California Gas (SoCalGas) system, and would ignore SDG&E's effort to prepare for electric restructuring through prepayment of SDG&E's global Settlement cost obligations to SoCalGas. Bowman stated that the PD's shift of ITCS responsibility to noncore customers represents a double-whammy to SDG&E's UEG. Bowman urged that the PD be revised to accept SDG&E's comprehensive gas resource plan, and that the PD's adoption of a 1995 start date for the plan be rejected. Bowman and Ward stated that the PD's recommendation to consider ratemaking treatment of SoCalGas' Line 6900 was unnecessary. Schneider stated that the PD's adoption of a replacement cost adder to marginal cost calculations is both theoretically incorrect and inappropriate. Schneider urged the Commission to adopt SDG&E's proposed refinement of the Marginal Demand measures. SDG&E Contact: Elizabeth Totah filed Tel: (415) 346-1385 03/14/97 A96-03-031 Southern California Gas Company, for authority to revise its rates effective January 1, 1997, in its Biennial Cost Allocation Proceeding, for a total reduction in annual revenues of approximately $147.9 million (5.7%). On March 12, 1997, Nettie Hoge, Executive Director of the Utility Reform Network (TURN), met with Cmmr. Knight in San Francisco. Also present were: Dorothy Duda, advisor for Cmmr. Knight; Michel Florio and Theresa Mueller, attorneys for TURN; Elena Schmid, Director of the Commission's Office of Ratepayer Advocates (ORA); and Sandra Fukutome, Mark Pocta and Steve Roscow, of ORA. TURN stated that the proposed decision (PD) would continue to deny core customers access to competitive benefits for no reason other than protecting noncore customers from rate increases. TURN stated that this was contrary to the Commission's statement in D9507048. Hoge, Florio, and Mueller stated that adoption of TURN's position would put an end to the continual battles over allocation of these costs as well as remove another barrier to the growth of core aggregation. TURN stated that deferral of this issue would be bad policy as well as inefficient, since it has been fully litigated. policy as well as inefficient since it has been litigated. TURN stated that parties should not be allowed to game the process by deferring fully litigated issues whenever they didn't like the outcome. TURN stated that without the adoption of replacement costs, Southern California Gas Company's marginal costs would be artificially low, thus providing protection from competition. TURN stated that adoption of the NCO method was consistent with the Global Settlement and with the Commission's policies for other utilities. Hoge stated that the PD defers implementation of the NCO method to protect noncore customers from cost increases, which was inconsistent with the Commission's commitment to cost based rates. TURN Contact: Jasmine Eleftherakis filed Tel: (415) 929-8876 Other Business Agenda No. 2947 June 6, 1996 LEG-1 SB 678 (Polanco) as amended on May 9, 1996. Would require that the Commission submit a report to the Legislature by July 1, 1997 that recommends an approach to financing existing low- income public policy prograns that does not create competitive imbalance between Commission- regulated natural gas providers and others. Commission voted 4-0 to approve recommendation to support the bill. Commissioner Fessler necessarily absent. HLEG-4 AB 2589 (Battin) as amended on April 17, 1996. Would require approval by April 1, 1997, of an experimental rate design, in Climatic Zone 15, which may diverge from the inverted rate structure mandated by Section 739 of the Public Utilities Code. Commission voted 3-1 to support recommendation to take a neutral position on the bill if funding to implement is provided. Commissioner Neeper dissented. Commissioner Fessler necessarily absent. HLEG-6 AB 2597 (Alby) as amended on April 24, 1996 and as proposed to be amended. Would provide that no privately owned or publicly owned public utility shall provide electric service to an existing retail customer of another utility unless the customer first enters into an agreement to pay an established nonbypassable severance fee or competitive transition charge. Commission voted 3-1 to support the concept of a nonbypassable competition transition change but oppose provisions of the bill which are inconsistent with the Commission's policy and Roadmap implementation decisions. Commissioner Knight dissented. Commissioner Fessler necessarily absent. REMOVALS FROM CALENDAR NONE
