Mueller stated that the alternate order should reject the Gas Accord and the market structure it would establish or modify it in several ways. Mueller explained that the discounting rule proposed in the assigned Cmmr.'s Ruling would not effectively mitigate Pacific Gas and Electric Company's (PG&E) conflict of interest or market power. Mueller stated that if PG&E controls both Line 300 and Line 401, there will be no incentive to discount line 300 in order to compete with line 401 and PG&E can use discounts on Pacific Gas Transmission Company to avoid the discounting rule for Line 401. Mueller added that discounting Line 401 for off-system sales to southern California would displace Southern California Gas Company's brokered capacity to the detriment of ratepayers. Mueller stated that the alternate is inconsistent in finding that PG&E failed to meet the "best efforts" standard for brokering core excess capacity but not providing a remedy for this rule violation. Mueller noted that 70% of the stranded cost remedy under the Accord goes to noncore customers and that no adjustment to the core fixed cost account is included. Mueller stated that the Alternate should either adopt the amount proposed on the record in TURN's testimony, or establish a forum in the future for determining the appropriate amount of disallowance.
