Elsesser suggested that further proceedings should be undertaken to examine the potential health impacts of the water utilities over the past 25 year. Goode suggested that, as drafted, the PD would cause confusion regarding the Commission's jurisdiction over water quality. Meeder emphasized his concerns about provisions of the PD pertaining to the potential liability of the water utilities, in particular, the PD's decision to leave open the question of whether a water utility could be held liable despite full compliance with Commission standards. Elsesser urged the Commission to accept further comments with the aim of further refining the analysis and supporting the proposed findings.
