Rostker, , counsel for IVCSD. Day stated that ratepayers in local communities are often better served when their local small water company is owned and operated by local government. Keller stated that it was important for IVCSD to own Bidwell in order to reverse a standing moratorium on new water hook-ups due to water supply problems. Keller stated that the local community faces economical hardship due to problems at Bidwell. Dunham stated that IVCSD is willing to purchase Bidwell. Dunhan stated that now that the financial problems of Bidwell have been discovered, IVCSD could not afford to purchase the company unless the Commission required Bidwell's present owners to restore the missing surcharge revenues that are the subject of the present investigation. Foster stated that Edison had communicated this fact to Enron before the motion was filed, but Enron broke off negotiations with Edison over a disagreement regarding the terms of a confidentiality agreement. Foster stated that granting the motion would severely restrict Edison's ability to negotiate restructurings with the QF community that maximize customer savings. Foster stated that Edison was working with many of the same QFs identified by Enron in its motion and with other third parties to restructure above-market contracts and, from Edison's perspective, Enron's motion represents an improper attempt to circumvent the over-all examination of QF restructurings that is pending before the Commission.
