Summary: On October 28, 1997, Keith McCrea, attorney for California Manufacturers Association (CMA), contacted Cmmr. Conlon in San Francisco. John Scadding, adv. to Cmmr. Conlon, was also present. McCrea expressed his concern regarding the petition for modification of D96-08-038 filed by the utilities insofar as it requests approval of Section 376 treatment. The loan guarantees provided by the utilities do not qualify under Section 376. Moreover, the Commission should defer taking any action on requests for Section 376 treatment until a generic Section 376 proceeding can be convened.
