Summary: On November 13, 1997, Thomas MacBride, counsel for the California Association of Competitive Telecommunications Carriers (CALTEL) sent a letter (attached to notice) to Cmmrs. Conlon, Duque, Bilas, Neeper, and Knight. A copy of the letter was also sent to: Izetta Jackson, counsel for the Commission; and Michael Sasser, for Pacific Bell. MacBride stated that CALTEL's presently pending application for rehearing of D96-03-021 raised issues different than that raised by Pacific Bell (PacBell) in its application for rehearing of D97-02-049. MacBride stated that while PacBell had requested that the Commission revisit usage estimates employed in the IRD decision, CALTEL sought correction of the Commission's failure to employ a mathematical factor arising out of PacBell's and GTE's methodology for billing surcredits. Filer: California Association of Competitive Telecommunications Companies Contact: Cindy Addad Phone: (415) 392-7900 11/17/97 A96-12-009 Pacific Gas and Electric Company, to identify and separate components of electric rates effective January 1, 1998, A96-12-011 San Diego Gas & Electric Company, for authority to unbundle rates, and products, and A96-12-019 Southern California Edison Company, proposing the functional separation of cost components for energy, transmission and ancillary services, distribution, public benefit programs and nuclear decommissioning, to be effective 1/1/98 in conformance with D95-12-036 as modified by D96-01-009, the 6/21/96 ruling of assigned Commissioner Duque, D96-10-074, and AB 1890. Summary: On November 4, 1997, Bruce Foster, Vice President of Regulatory Policy and Affairs for Southern California Edison Company (Edison), met with Cmmr. Conlon, in San Francisco. Also present were: James Hendry and John Scadding, advisors to Cmmr. Conlon; and Michael Hoover, Edison's manager of Regulatory Policy and Affairs. Foster stated the necessity of delaying Commission action on ALJ Malcolm's opinion on Edison's petition so that an alternate proposed decision could be put forth approving Edison's petition in three key areas: allocation of franchise fees, allocation of load dispatching costs, and disposition of the project development costs of the Devers to Palo Verde Transmission line. Foster stated that franchise fees have nothing to do with generation, and that Cmmr. Neeper encouraged the utilities to file a petition to modify the decision to reallocate franchise fees to distribution. Foster stated that the draft opinion on Edison's petition misinterprets SB 703 and Sections 6350-6354 of the Public Utilities Code. Filer: Edison Contact: Bobbie Cao Phone: (626) 302-2310 Summary: Late Filed. On November 4, 1997, Bruce Foster, Vice President for Southern California Edison Company (Edison), met with Cmmr. Neeper, in San Francisco. Also present were: David Gamson, advisor to Cmmr. Neeper; and Michael Hoover, Edison's Manager of Regulatory Policy and Affairs. Foster stated the necessity of delaying Commission action on ALJ Malcolm's opinion on Edison's petition so that an alternate proposed decision could be put forth approving Edison's petition in three areas: allocation of franchise fees, allocation of load dispatching costs, and disposition of the project development costs of the Devers to Palo Verde transmission line. Foster stated that franchise fees have nothing to do with generation, and that the Commission appears to expect Edison to provide ongoing services for the Independent System Operator without providing Edison a method to recover the majority of the costs necessary to fulfill those obligations. Foster stated that the ALJ's opinion incorrectly rejects Edison's proposal to recover $6.7 million through a one-time adjustment in the 1997 ERAM account.
