Summary: On November 25, 1997, Karol Sweitzer, Pacific Bell Communications (PBCOM) Vice President-Regulatory, sent a three-page letter (attached to the notice) to Cmmrs. Conlon, Knight, Duque, Neeper and Bilas; and their advisors. The letter is in response to TURN's recent letter to the Commissioners dated October 30, 1997, and the subsequent ex parte communication late filed on November 5, 1997. PBCOM's letter corrects misstatements made by TURN regarding PBCOM's motion to delay the Commission's decision on the above captioned proceeding until clarification is provide by the FCC. On November 24, 1997, Kristel L. Frank, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), contacted Cmmr. Neeper in San Francisco. Also present at the meeting were: David M. Gamson, adv. to Cmmr. Neeper; Leslie Everett, Vice President and Project Manager of Divestiture for PG&E; and Joe Malkin, attorney, representing PG&E. A copy of a one- page handout entitled, "Pacific Gas and Electric Company, Divestiture of Morro Bay, Moss Landing and Oakland Power Plants, A96-11-020" was presented. The handout is attached to the notice. The handout outlines the November 18, 1997 sale of PG&E's power plants to Duke Energy Power Services, Inc. for $501 million. Everett stated that PG&E completed its auction for the sale of Morro Bay, Moss Landing, and Oakland power plants consistent with the Commission's directives. Frank stated that because PG&E has announced plans to sell virtually all of its fossil generation assets, PG&E is requesting a 42 basis point increase in the rate of return now, and ultimately will ask for a 99 basis point increase, consistent with the Commission's December 20, 1995, preferred policy decision. Malkin explained that PG&E is earning only 90 percent of the long-term cost of debt for its generation assets eligible for transition cost recovery. He also stated that it is PG&E's understanding that 10 additional basis points would be applied to all of it's fossil generation assets for each 10 percent of generation assets sold, consistent with the preferred policy decision.
