Summary: On December 15, 1997, Glen Sullivan, attorney for Southern California Gas Company (SoCalGas), caused a letter (attached to this notice) jointly from SoCalGas and California Cogeneration Council (CCC) to be delivered by hand to all five Commissioners and Cmmr. Advs. Michelle Cooke, Dorothy Duda, David Gamson, Julie Halligan, James Hendry, and Robert Lane. The letter was dated December 15, 1997, signed by Lee M. Stewart, Senior Vice President of SoCalGas, and Ann MacLeod, Executive Director of CCC. The letter states that SoCalGas, CCC and Watson Cogeneration Company have reached agreement on a proposal for the future of cogeneration parity. The proposal calls for the creation of a single rate class for all customers in SoCalGas' service territory who use gas to generate electricity, including UEGs, purchasers of plants formerly owned by UEGs, cogenerators, and developers of new generating plants. The letter states that the parties hope the Commission will approve the full proposal when it is presented in a formal proceeding. The letter also states that CCC decided to support the Pacific Enterprises - Enova Corporation merger upon SoCalGas' agreement to support a single electric generation class as a market power mitigation measure in the instant merger application. A copy of the settlement agreement is attached to the letter.
