GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). On the same date, June 24, 1998, Sarah Smith spoke to David Gamson. A letter (attached to the notice) addressed to Paul Clanon on April 21, 1998, was mentioned. Smith stated that she would provide a copy of the letter to David Gamson. Smith argued that the Energy Division misunderstands Edison's request in its advice letter 1298-E for a transmission revenue requirement reclassification memorandum account (TRRRMA). Smith explained that it is not Edison's intention to establish the rate credit approach, and that, rather, the TRRRMA, consistent with D97-05-056, will provide Edison only the opportunity, not the guarantee, of recovery, of distribution related costs, when and if they are deemed non-transmission cost by the Federal Energy Regulatory Commission (FERC). Smith also explained that, to address retroactive ratemaking concerns, Edison requested the opportunity to record amounts in the TRRRMA beginning with the start of Direct Access. Smith stated that without the TRRRMA, Edison is at risk that its transmission revenue requirement is in place subject to refund, until such time as the FERC makes its final determination of the categorization of the cost in question. Hoover said that SCE intends to comply with the credit methodology the Commission establishes. However, SCE has been operating under the impression that in D97-05-039 the Commission established that credits would go to end-use customers, and has been modifying its systems to work with that directive. Hoover pointed out that if the Commission overturns its prior decision and requires that credits be paid directly to Energy Service Providers, there will need to be further system modifications and will not be able to implement by January 1, 1999, and that will result in increased costs.
