GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). Summary: On August 27, 1998, at an all party ex parte meeting held at CPUC, San Francisco, representatives from Teligent, Inc. ("Teligent") conveyed written ex parte communications to Commissioner Knight. Teligent attendees conveying the communications were David Turetsky (Vice President of Law and Regulatory), David Simpson (counsel), and Phuong Pham (counsel). The next day, August 28, a separate one page facsimile was transmitted by Teligent to Dorothy Duda, an advisor to Commissioner Knight. At the meeting Teligent provided the commissioner a one page pictorial illustration with written commentary. It was entitled "access to rights-of-way within multi-tenant buildings." The illustration had various components depicting the side view of a multi-tenant building, with the components labeled and additional comments affixed. One such component was labeled "riser cables" and the comment "wireline CLCs need access to riser cables" affixed. Another comment was "incumbent LECs (e.g. Pacific Bell, GTE) have access to riser cables." Contact: Martina Hassett Phone: (415) 291-1970 Summary: On August 28, 1998, the City of East Palo Alto sent a letter to the CPUC expressing "grave concern" over the draft decision's proposal to establish the Commission as the agency of last resort to resolve the complaints of telecommunications carriers regarding access to public rights- of-way. The three (3) page letter was addressed to Commission President Bilas and signed by Senior Assistant City Attorney Grant Kolling. Copies were provided the other four (4) commissioners, Administrative Law Judge Pulsifer, and five (5) advisors to the respective commissioners. Mr. Kolling asserted the proposal presumes that cities have acted in an arbitrary and capricious manner in managing the rights- of-way, but he countered that "nothing could be further from the truth." Various other assertions in opposition to the proposal were submitted by the city attorney, including "the draft decision's proposal to use a sledge hammer to swat at what is perceived to be a persistently pesky horse fly problem will destroy the progressive steps that forward- thinking cities have made to coordinate and facilitate competition while exercising their obligations to manage the rights-of-way in trust for their citizens." Mr. Kolling added that "Unverified rumors and allegations should play no role in the making of sound public policy." In the last paragraph, the city requested that the Commission refrain from adopting the draft decision's proposal. Mr. Kolling's letter is attached to the Ex Parte notice.
