GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). If agenda items (including revisions) are not ready on the distribution date, they will be made available at no charge in the lobby outside the Commission Auditorium at 9:00 a.m. on the morning of the Commission meeting, but not earlier. Number pooling offers the potential to reduce NXX demand by enabling multiple carriers to share numbers from a single NXX code. A workshop is scheduled to initiate a plan to implement number pooling within California in cooperation with the program underway at the national level. Town Hall Meeting October 7, 1998 The Sherman Community Center 7 pm 2258 Island Avenue San Diego CPUC Commissioner Josiah Neeper will hold an open forum on telecommunications marketing abuses affecting Spanish- speaking consumers in the San Diego area. The purpose of the meeting is to provide the Hispanic community an opportunity to learn about such marketing abuses as slamming and cramming, and to express their concerns. Commissioner Neeper scheduled the meeting as a result of discussions with Hispanic community leaders. He will welcome comments from all consumers on these and related issues. Mr. Selby stated his representation was on behalf of the "California Rights-of-Way Coalition" ("Coalition"), consisting of the ICG Telecom Group, Inc., AT&T Communications of California, Inc., MCI Telecommunications Corp, and AT&T Local Services. Mr. Selby initiated calls to Jose Jimenez, advisor to Commissioner Conlon, and Dorothy Duda, advisor to Commissioner Knight. Ms Duda was not in her office, and Mr. Selby's message was left by voice mail. The case faxed to both advisors was Salvaty v Falcon Cable Television (1985) 165 Cal.App.3d 798. Mr. Selby then said conclusion of law "6" of the 8/31/98 "Escutia" version of the revised draft decision was in conflict with the Salvaty case. He said the words "and the underlying property owner" should be deleted from the conclusion of law. Otherwise, Mr. Selby said, CLC's would be prevented from attaching utility support structures whenever utility poles or conduit systems happened to "dog leg" across private properties or run along shared property lines. This could limit CLC access to utility support structures, Mr. Selby said, thus eliminating any value in the decision for CLC's and damaging the development of facilities based competition in California. Summary: On September 15, 1998, three (3) Pacific Bell ("PacBell") representatives initiated a meeting with Commission President Bilas and his advisor, Lester Wong, and conveyed oral and written ex parte communications. The PacBell agents were James Callaway, William Blase, and Daniel McCarthy. Mr. McCarthy stated that PacBell found the draft NRF decision overall to be sound. He said the draft decision discussion of the productivity factor and earnings regulation supports elimination rather than suspension of these aspects of NRF. He said the Commission should resolve now the question of PBOP's in I90-02-047. The PacBell representative provided the commissioner and advisor copies of the draft and final Resolution No. T-16102 and a transcription of the 12/16/97 Commission conference which, he said, demonstrate the issues which were to be determined relative to PBOP's in I90-02-047 were to be prospective only.
