GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). The purpose of the meeting is to provide the Hispanic community an opportunity to learn about such marketing abuses as slamming and cramming, and to express their concerns. Number pooling offers the potential to reduce NXX demand by enabling multiple carriers to share numbers from a single NXX code. A workshop is scheduled to initiate a plan to implement number pooling within California in cooperation with the program underway at the national level. The October 16, 1998 second workshop will further address the formation of a number pooling task force and develop administrative protocol for the ongoing operation of the Task Force and for the submission of progress reports to the Commission. Summary: LATE FILED. On September 22 and 24, 1998, respectively, Barbara Kaufman and David A. Jones wrote ex parte letters to all of the commissioners and certain other PUC officials. Ms Kaufman is a member of the Executive Board of the League of California Cities, and President of the Board of supervisors of the City and County of San Francisco. Mr. Jones is the Legislative Representative of the Leage of California Cities. The Notice of Ex Parte Communications was filed by the Office of the City Attorney, City and County of San Francisco on behalf of the League of California Cities ("League"). Both letters were attached to the notice. Ms Kaufman's letter expresses opposition to the draft decision's proposal that the Commission act as a "pre-trial tribunal" on rights-of-way disputes between local governments and telecommunications carriers. She said such a proposal would interfere with San Francisco's ability to manage utility access to its public rights-of-way. She urged the draft decision be amended accordingly. Ms Kaufman's further expressed support for an informal mediation process to resolve such disputes as recommended by the League. Mr. Jones' letter stated the same positions as put forth by Ms Kaufman, but it went into additional detail on how such an informal mediation process would operate. Gardner, of the California Cable Television Association ("CCTA") hand delivered a two and a half (2 «) page ex parte letter to all the commissioners and their respective advisors in the proceeding and to CPUC General Counsel Arth. The letter, addressed to Commissioner Conlon, stated CCTA's "grave" concern with conclusion of law "16" in the Rights-of-Way draft decision which validates pre-existing arrangements for access to utility ROW notwithstanding such terms and conditions may differ from those promulgated in the Commission decision. The CCTA letter states such a provision in the draft decision "is nothing less than an abrogation of.(the Commission's).responsibilities. and it leaves many parties without recourse to unfair conditions which were agreed upon years ago." The CCTA letter further cites legal authority by federal courts and the Federal Communications Commission that the Commission does have the authority to review existing rights of way contracts. The letter said utilities attempting to enforce pre-existing arrangements are those that are now attempting to enter the telecommunications market, and he cited Edison and CCTA's current complaint against Edison on pole access as an example. Summary: LATE FILED. On September 23, 1998 Mona Petrochko representing Enron Corporation ("Enron") met ex parte with Commission President Bilas at CPUC headquarters. Enron initiated the meeting. Ms Petrochko stated that while Enron was pleased with the fact that the Phase 2 decision in the revenue cycle services proceeding included credits based on long run marginal cost as their ultimate goal, but that the longer the short term avoided cost credits adopted by the decision remained in effect, the harder it will be for competitors to attract customers, thereby potentially decreasing the field of viable competitors. Ms Petrochko also expressed disagreement with the decision's implication that all alternate providers of RCS were fully integrated and able to absorb overhead and fixed costs for RCS offerings through related products. She said such is not a good economic proposition for integrated companies, but it may serve to squeeze more specialized companies out of the industry. Ms Petrochko expressed concern as to the lack of comparability between the amounts charged by the UDC to provide a revenue cycle service and the amount avoided by a customer by not taking that same service from the UDC. The AES Pacific representatives asked that the Commission give timely consideration to AES Pacific's petition for modification of D94-06-050 and D95-03-019. The AES Pacific justified the relief requested in the subject petition, including its request to find that AES Pacific has a binding Standard Offer 4 contract with Pacific Gas and Electric Company (PG&E), and that AES Pacific is entitled to recovery of costs it reasonably incurred in developing and pursuing its power plant project as the winning bidder in PG&E's BRPU auction.
