GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). SUBSCRIPTION INFORMATION Subscription Notice for Draft Agenda Items In compliance with Public Utilities Code Section 311.5, parties who wish to subscribe to receive draft agenda items may do so by writing to the Public Utilities Commission; Attention: Poly Arca, Room 1003; 505 Van Ness Avenue; San Francisco, CA 94102; or by calling (415) 703-1798. The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. The package you receive via mail will include only those agenda items available at the time of the agenda distribution date, which is usually 10 to 12 days prior to the Commission meeting. If agenda items (including revisions) are not ready on the distribution date, they will be made available at no charge in the lobby outside the Commission Auditorium at 9:00 a.m. on the morning of the Commission meeting, but not earlier. In addition, the Commission will make draft agenda items available for viewing and photocopying (at 20 cents per page) at the Commission's Central Files Office (Room 2002), 505 Van Ness Avenue, San Francisco, and in the Los Angeles, San Diego, and the following field offices: El Centro, Eureka, Sacramento and San Bernardino. Since the agenda package will be mailed to these locations, it will be available at these locations a day or two after the distribution date. The presentation was entitled "Challenges Facing Cox as a Facilities Based Competitor." The location of the briefing was 5159 Federal Boulevard in San Diego. The other PUC staff members in attendance were the director and assistance director of the Consumer Services Division and a member of the Public Advisor's staff from PUC's San Diego office. Cox representatives attending were Richard Smith, William Geppert, Mary Ball, Bill Fitzsimmons, Jacqui Vines, Steve Gautereaux, Roger Kain, Randy Gohler, Stan Gafner, Robert Long, Sheri Stinchcomb, Art Reynolds, David Vaughn, Marco Valenti, and John Chan. In addition to the oral presentation, a thirteen (13) page handout was provided the PUC attendees. Cox indicated the key issues facing the company included: (1) access to multi-tenant properties, (2) access to telephone numbers, (3) access to the remainder of the telephone network, and (4) access to effective operational support systems. Cox said 52% of San Diego's residents live in rental housing and 40% of the homes serviced by Cox are multi-dwelling units ("MDU"). Cox urged the Commission to ensure non-discriminatory access for CLC's to incumbent local exchange carrier ("ILEC") controlled facilities on MDU's, to enforce access to MDU wiring and conduit, and ensure MDU owners are not denied access to competitive alternatives because of existing arrangements of ILEC facilities on MDU properties. In regard to developing competition in California, Cox stated there is a continuing problem of access to telephone numbers, and frequent controversy over area code realignment and rationing among 182 million telephone numbers. Mr. Smith stated only a fraction of the state's 182 million numbers are presently assigned, and that the number "shortage" was due to the way that telephone numbers are allocated to carriers. Neither the geographical nor overlay approaches address the inefficiencies of current number allocation procedures, Mr. Smith said, and that only number conservation methods could dramatically reduce the need for frequent area code relief. Cox urged PUC to implement the porting of unassigned numbers and individual telephone number pooling. Contrary to most businesses, Cox stated, local exchange carriers must cooperate with each other, else an uncooperative ILEC can impair the quality services of new carriers in response to events occurring within the ILEC's network. Mr. Smith stated that competitive local carriers' ("CLC's") service quality is directly affected by problems caused by an ILEC within the ILEC's network. CLC's must rely on the ILEC's for access to the remainder of the public switches network, Cox said, but ILEC's have delayed CLC orders for trunk connections. Cox said some ILEC's have intentionally prevented their customers from calling CLC customers, or have failed to promptly load and retain CLC NXX codes in ILEC switches. ILEC's have generally been unresponsive to CLC trouble reports, Mr. Smith said, and that they are often unwilling or unable to identify the source of problems in ILEC networks which are negatively affecting CLC services. He urged PUC to establish operational support system ("OSS") performance standards and enforcement mechanism for ILEC provisioning to CLC's. Cox said the Commission's proposed end user service quality standards would be stricter than existing inter-company standards. This could place CLC's in a "squeeze," Mr. Smith said, between strict end user requirements and the more lenient requirements for ILEC's provisioning of service to CLC's. Mr. Smith concluded by saying the Commission should coordinate any end user new service quality standards with OSS performance standards.
