Duque in San Francisco. Also present were: Tim Sullivan, advisor to Cmmr. Duque; ALJ Galvin; Andrew Ulmer, staff attorney, and William Johnston, analyst, for the Office of Ratepayer Advocates; Terry Murray, president of the consulting firm Murray & Cratty; James Tobin, Stan Doten and Ruth Ann Keene, of Morrison & Foerster, representing the County of Los Angeles; and Tim Dawson, counsel, and Linda Van De Loop and Lynn Mowery, Regulatory Affairs representatives, for Pacific Bell (PacBell). Stein explained that TURN intends to present an analysis of PacBell's cost of providing directory assistance (DA), but that PacBell believes such an inquiry is beyond the scope of the proceeding. Stein suggested that the Commission should not rely solely on PacBell's open access and network architecture development cost study because it is based on 1994 data, and may not reflect recent efforts by the company to reduce its costs of DA. Stein also explained that the opposing parties need clarification of the scope of issues in order to plan the extent of their participation in the case. Along with Ulmer and Tobin, Stein requested a ruling clarifying that parties would be permitted to litigate PacBell's asserted costs of providing DA service. Duque in San Francisco. Also present were: Tim Sullivan, advisor to Cmmr. Duque; ALJ Galvin; Andrew Ulmer and William Johnston, of the Office of Ratepayer Advocates; Terry Murray and Paul Stein, of The Utility Reform Network; Tim Dawson, Linda Van De Loop and Lynn Mowery, of Pacific Bell (PacBell); and Stan Doten and Ruth Ann Keene, Counsel for the County. Tobin explained the County's position that Pacific Bell's actual costs in providing directory assistance (DA) must be considered in setting a reasonable price for these services. Tobin questioned the use of a 1994 cost study in setting prices in 1998. As an example of why PacBell's actual costs must be considered, Tobin cited PacBell's planned offering of national DA and questioned how much of PacBell's asserted costs for DA should be allocated to this new service. Finally, Tobin expressed the County's concern, on behalf of the County's residents, that PacBell's cost studies in 1994 may not have been able to anticipate subsequent events, such as PacBell's merger with SBC Communications, which have substantially changed the costs asserted by PacBell in 1994.
