Decision 98-08-037 found there is a need for a fresh review of lottery procedures. In this second workshop, the lottery process will be reviewed to determine if there are ways to make the distribution of NXX codes among carriers more equitable, and more conducive to the development of competition. Specifically, the topic of increasing the percentage of initial codes assigned from the lottery from the current 60% to a higher amount will be explored. Participants should come prepared to address potential reform measures for the lottery, identify potential shortcomings and suggest ways to revise the lottery process to promote a more competitive market including potential revisions in the allocation between initial and growth codes. The Commission may vote on this resolution at that time, or it may postpone a vote until later. When the Commission votes on a draft resolution, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution. ORA commented that the use of a depreciation schedule to depreciate old equipment at a power plant did not mean that the physical useful life of a piece of equipment was the appropriate measure to use when calculating the economic risk that a capital addition would generate enough revenues to cover its cost during its useful economic life. Everett states that PG&E seeks final approval of the sales of the Delta (Pittsburg and Contra Costa), Potrero, and Geysers (Sonoma County Units and Lake County Units) power plants. The letter explains that the sales of these facilities to Southern Energy, Inc., FPL Energy, Inc. and Calpine Corporation bring aggregated gross proceeds of $1.014 billion, fully recover the net book value of the plants and result in a contribution to the transition cost balancing account, net of taxes and transactions costs, of approximately $409 million. Everett also points out that the sale of the Sonoma County Geysers Units is still subject to a right of first refusal held by the steam suppliers, Union Oil Company of California, NEC Acquisition Company, and Thermal Power Company (collectively, "U-N-T"). The letter specifies that U-N-T must exercise its joint right of first refusal by February 22, 1999. Wilson urged the Commission to defer a decision on the final arbitrator's report pending public input and comment on an issue central to the matter - whether the Federal Communications Commission (FCC) intended to pre-empt the States from defining sub-elements of the local loop as additional unbundled network elements. Wilson explained that this issue was not fully briefed and has a significant bearing on the Commission's role under the Telecommunications Act of 1996. Wilson further states that the implications of the final arbitrator's report go far beyond the interests on the two litigants. Referring to the fact that the FCC has itself sought comment on whether or not there should be a national requirement for sub-loop unbundling, Wilson states that the arbitrator wrongly concludes that by asking this question, the FCC has impliedly stated that there is no room under current rules for a state imposed requirement.
