Bilas; Bill Blase, Vice President-Regulatory, for Pacific Bell (PacBell); Jim Calloway, President-Public Affairs, Pacific Telesis (PacTel); and David Discher, Senior Counsel, PacTel. Mazique stated that internet provider service (ISP) traffic and internet service are jurisdictionally interstate, not local, traffic. Mazique stated that the interstate nature of ISP traffic is well established by FCC decision and court decision. Mazique asserted that if ISP traffic were not interstate in nature, the FCC could not regulate it, and that in a recent pleading filed with the FCC, the Commission itself referred to ISP traffic as interstate. Mazique stated that internet communications do not end at the ISPs server, instead they continue from the end user to the server of the web site at the ultimate destination of the call, which may be interstate or international, and that is the source of the FCC's jurisdiction. Mazique stated that the co-carrier agreement between Pacific and Pac-West provides for reciprocal compensation for the exchange of local traffic only. Mazique stated that compensation for interstate traffic is provided through a subsequent meet point billing agreement, and that Pacific and Pac-West never negotiated compensation for ISP traffic. Mazique stated that Pac-West never mentioned in negotiations that it intended to claim reciprocal compensation for ISP traffic and Pacific never intended for the reciprocal compensation provisions in the Agreement to apply to ISP traffic. Mazique stated that Pac- West claims to provide lower-priced services than PacBell and to relieve PacBell of traffic. Mazique stated that Pac-West can afford to offer lower priced services to ISPs because it wants Pacific to pay it for the termination of ISP traffic on its network. Mazique stated that Pac-West also avoids sharing the cost of providing local toll services by rating calls as local when in reality they travel more than 12 miles and should be rated as toll calls. Mazique stated that Pac- West does not relieve Pacific of traffic, Pac-West communications travel over Pacific's facilities before reaching Pac-West and Pac-West traffic causes problems for Pacific's network.
