Finkelstein stated that TURN had received an unredacted copy of Edison's application and supporting testimony. Finkelstein stated TURN's concerns that any stipulated factual record be based on reasonable potential outcomes on the issues, rather than a clearly unreasonable outcome that might be agreed to simply for convenience. Finkelstein also stated why TURN believes consolidation of this proceeding with the San Diego Gas & Electric BRPU application makes sense by ensuring consistent Commission outcomes on the BRPU buy-outs. ORA participated in two of the three communications. At the first meeting, Phyllis Huckabee, Director of State Regulatory Relations for SoCalGas, met with Cmmr. Conlon. Also present were: James Hendry, advisor to Cmmr. Conlon; Johannes Van Lierop, Director of Governmental Affairs for SoCalGas; and Dexter Khoury, Public Utilities Reuglatory Analyst III for ORA. Huckabee stated that the settlement reached between SoCalGas, ORA, and TURN was unopposed and addressed concerns regarding the determination of incremental load that would be eligible for discounting. Huckabee stated that uncertainties created by the pending Gas Strategy could be resolved at some point in the future, but that the outcome of the Gas Strategy was far from certain and should not be allowed to prevent action on a mechanism that was already approved in SoCalGas' PBR. Van Lierop stated that the settlement recognizes the Commission's authority to review all negotiated agreements or optional tariffs. Van Lierop stated that language in General Order 96-A provides customers with notice that changes to the program could occur, and that the Commission can make changes as circumstances warrant, including changes from a bundled to an unbundled environment. Van Lierop stated that shareholders are responsible for reductions in core revenues under this program and that is stated in the draft decision. Khoury stated that ORA had also been concerned with "freeriders" under the proposed program and that the settlement addressed those concerns. Khoury stated that ORA would exercise its right as a party to examine all requests by SoCalGas to serve customers under this program as well as closely review all annual filings. At the second meeting, Huckabee met with James Hendry, advisor to Cmmr. Conlon. Also present were: Van Lierop, and Khoury. Van Lierop stated that the ITCS account is not impacted by this program and that any adjustments with respect to this program impact only CFCA. Van Lierop stated that the ITCS and CFCA are separate and reiterated shareholder responsibility for revenue shortfalls. Khoury stated that the motion granted by the draft decision provides more detail on how the program will work and that ORA will continue to watch for inappropriate requests by the utility to offer discounts under this program. At the third meeting, Huckabee met with David Gamson, advisor to Cmmr. Neeper. Huckabee stated that SoCalGas had met with Hendry and hoped that his concerns had been resolved regarding shareholder responsibilities, particularly for ITCS revenues. Huckabee also asked that the second ordering paragraph of the draft decision be revised before the Commission issues its decision in the matter.
