Levy stated that the original contract provided solely for a 40 MW facility, and that nowhere in the contract provides provision for the QF building a 56 MW facility. Mr. Worden told Mr. Hendry that he appreciated the wishes of some of the parties tom find new Competition Transition Charge (CTC) exemptions through novel interpretations of Assembly Bill (AB) 1890. He further added that it is important for the Commission to prevent the kind of CTC cost- shifting that would prevent from such an interpretation as that being advocated by IEP, Enron, Destec, And NEO Corporation in their recent ex- PARTE communications. Worden, Regulatory Affairs Manager for Edison met with Michelle Cooke, Advisor to Commissioner Duque at the Commission's San Francisco office. Mr. Worden referred to the January 16, 1998 letter sent to the Commissioner's from The Independent Energy Producers (IEP). Mr Worden stated that IEP's letter advocated a new interpretation of Public Utilities Code section 369 that reversed IEP's previous position. Mr Worden informed Ms Cooke that IEP had signed a Memorandum of Understanding (MOU) with Edison and several customers groups that was filed with the Commission on September 18, 1995 in the Electric Restructuring Docket (R.94-04-03/I.94-04-032). The MOU was consistent with the draft decision on this issue currently pending the Commission's vote. He stated that Edison was surprised with IEP'S new interpretation and the transition cost-shifting it would cost. He indicated that the draft decision on this subject should be prevalent.
