The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. In his letter, Mr. Fielder responded to a January 16, 1998, ex-parte letter from Mr. Jan Smutny-Jones of the independent Energy Producers (IEP) regarding Public Utilities Code 369. He informed the Commissioners that IEP's letter advocated an interpretation of section 369 that is contrary to the legislative intent and that would shift responsibility for the Competition Transition Charge to other customers. Mr. Fielder stated further that the various provisions of Assembly Bill (AB) 1890 were preceded by the Commission's Preferred Policy Decision. And that one of the inputs of the Preferred Policy Decision was a Memorandum of Understanding that Edison, IEP, and several large groups had entered into and that was filed with the Commission in January of 1995. The MOU included a provision in which the signatories agreed that only customers no longer taking any service whatsoever from or through the facilities of the utility would be exempt from the CTC . He stated that the interpretation of section 369 in IEP'S recent ex-parte letter was contrary both to the legislative intent and to the MOU that IEP had agreed to. Mr. Fielder pointed out that Section 369 codified the same policy of narrow CTC exemptions embodied in the MOU, in that it requires that CTC be collected from all the existing and future customers in the utility service territory. He pointed out that section 372 exempts from CTC up to 120% of the load from the cogeneration and self-generation projects that meets the specified on - line dates. IEP and other parties are complaining about the interpretation of section 369 because some of their cogeneration projects may not qualify under the specific exemption provision of such projects in section 372 Mr. Fielder's letter concluded. The IEP'S position on this issue represent complete change of position from the position it endorsed in the Memorandum Of Understanding that was filed in the Commission's Electric Restructuring Docket (R94-04-031/I94-04-032), on September, 18, 1995, added Mr. Worden. He pointed out that Edison does not now have, and never has had, a separate, Stand- by Tariff. Instead, Edison's stand by charge is an integral part of it's otherwise applicable tariff. If the Commission approves the merger, the combined WorldCom-MCI entity will enjoy MCI's brand name, and thus will have no incentive to continue participating in the wholesale long distance market.
