The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. Summary: On February 11, 1998, Richard Farman, President and Chief Operating Officer for Pacific Enterprises and Frederick E. Mr. Farman stated that there is no logical basis for the application of the affiliate rules to transactions between SoCalGas and SDG&E. He explained that applying the rules could eliminate up to $343 million in merger savings. He stated that SoCalGas and SDG&E are both represented by the Commission, and that why should the ratepayers and shareholders be denied merger savings when there are no anti-competitive or cross-subsidy issues involved. He stated that a reasonable sharing mechanism and exemption from the affiliate transaction rules are critical elements to assure an equitable distribution of merger savings between ratepayers and shareholders. Mr. Farman further stated that the ten-year sharing mechanism proposed by Pacific Enterprises and Enova Corporation is appropriate to balance the interest of ratepayers and shareholders and not the five-year treatment being considered by ALJ Barnett, which raises concern with respect to the treatment of merger savings the first five years. Mr. Farman stated that Pacific Enterprises shareholders must receive some assurance as to the manner in which all savings will be treated in order to assess the total cost and benefit of the merger. And that Pacific would consider an alternative approach to the sharing of merger savings as long as it accounts for the full ten years of the forecasted merger saving, with cost-to-achieve amortized over ten years. Simpson stated his clients position that they were disadvantaged by the bidding strategies of these other bidders and are therefore entitled either to negotiate a settlement with Edison or obtain a BRPU contract.
