GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). Ratesetting proceedings include complaints that challenge the reasonableness of rates or charges, past, present, or future. N/A Removed from the SB 960 category requirements. Summary: On March 24, 1998, Phylis Huckabee, Director- State Regulatory Relations for Southern California Gas Company (SoCalGas), left voice mail messages: one for Robert Lane, advisor to Cmmr. Knight, and for Michelle Cooke, advisor to Cmmr. Duque. Huckabee stated that Pacific Enterprises (PE), and Enova can support three changes with respect to market power issues. Huckabee stated that the applicant supports, adding language to the merger decision which clearly indicates that this case does not prejudge the market power issues being examined in the Commission's gas strategy rulemaking. Huckabee also noted the willingness of SoGalGas to post information on it's gas bulletin board, every hour within the hour, pertaining to interstate deliveries on a receipt point basis, as well as hourly storage flow rates. Finally, Huckabee stated that PE and Enova are willing to accept an outside auditor to monitor functionings of SoCalGas' storage and transmission facilities and report findings to the Commission as an expert witness in the gas strategy rulemaking. Filer: Pacific Enterprises/Enova Corporation Contact: Artemis Manos Phone: (213) 895-5236 Summary: On March 24, 1998, Michael Hoover, Manager of Regulatory Affairs of Southern California Edison Company's (Edison), had three separate meetings: with Julie Halligan, advisor to Cmmr. Bilas, in San Francisco; David Gamson, advisor to Cmmr. Neeper; and James Hendry, advisor to Cmmr. Conlon. A new conclusion of law (attached to the notice) was used during these meetings. On the same day, March 24, 1998, Edison delivered to the offices of Cmmr. Conlon and his advisor James Hendry, a letter (attached to the notice) written by Bruce Foster, Vice President of Regulatory Affairs for Edison, in San Francisco. A copy of the letter was also delivered to the offices of Cmmr. Conlon; offices of Cmmr. Bilas and his advisor, John Scadding; Cmmr. Knight and his advisor, Bob Lane; Cmmr. Duque and his advisor Michelle Cooke; and to Cmmr. Neeper and his advisor David Gamson. A new conclusion of law, used in meetings with Julie Halligan, David Gamson and James Hendry, was concerned with no antitrust immunity for anti-competitive behavior of the merged company. During these meetings, Hoover stated that adding the new conclusion of law to either the proposed decision or the alternate was not a substantive change. The letter of Bruce Foster contained Edison's changes to Applicants' remedial measures, s summary of the recommended changes and the record support for each change. The letter discussed primarily the need for posting within one hour on gas select of any executed transactions or transmission of relevant information between Southern California Gas Company and one of its affiliates, including San Diego Gas and Electric Company. The letter also discusses Edison's response to applicants' claims regarding Edison's quantitative modeling analysis and summarizes the record that indicates how the merged entity can profit from an increase in gas prices. Filer: Southern California Edison Company Contact: Kellie Bearman Phone: (626) 302-3124 Summary: On March 24, 1998, Frederick John, Senior Vice President of Public Policy and Law for Pacific Enterprises (PE), initiated three telephone communications: with Cmmr. Conlon; James Hendry, adivsor to Cmmr. Conlon; and Cmmr. Bilas. In all three communications also participated William Reed, Vice President of Regulatory and Governmental Affairs for San Diego Gas and Electric Company; and in the first communication James Hendry, advisor to Cmmr. Conlon also took part. In their first communication, with Cmmr. Conlon, John and Reed stated that PE and Enova cannot accept a trustee for storage and transmission facilities, even as an interim arrangement. Reed stated that the market power concerns being raised by some parties have already been determined to be invalid or resolved by divestiture of Enova's fossil plants. John stated that those objecting to the merger are competitors with an interest in reducing the effectiveness of the combined PE/Enova companies as a competitor. In their second communications, with James Hendry, and their third communication, with Cmmr. Bilas, Reed stated that PE/Enova oppose the measures proposed by Southern California Edison Company (Edison) in its March 24 letter to Cmmr. Conlon. Reed stated that Edison is rehashing old arguments that have already been denied by the Commission, the FERC, the Attorney General, and the Department of Justice. John stated that Edison proposed changes that are unsupported by the record. John and Reed stated that, although PE/Enova continue to oppose a trustee for operation of SoCalGas' storage and transmission facilities, the companies are willing to accept an outside auditor to monitor functioning of the SoCalGas storage and transmission facilities and report to the Commission as an expert witness in the gas strategy rulemaking. Filer: Pacific Enterprises/Enova Corporation Contact: Artemis Manos Phone: (213) 895-5236 Summary: On March 24, 1998, Frederick John, Senior Vice President of Public Policy and Law for Pacific Enterprises (PE), contacted Cmmr. Conlon by telephone in San Francisco. Also participating in the conversation were James Hendry, advisor to Commissioner Conlon; John Scadding and Julie Halligan, advisors to Cmmr. Bilas; William Reed, Vice President of Regulatory and Government Affairs for San Diego Gas and Electric Company. Reed and John reiterated the willingness of PE/Enova to have an outside auditor monitor operation of Southern California Gas Company's (SoCalGas)' storage and transmission facilities during the pendency of the gas strategy rulemaking proceeding and report to the Commission as an expert witness in that proceeding. John stated that the conditions under which an auditor would review the operation of SoCalGas' storage and transmission facilities should be contained in the proposed decision and in Cmmr. Neeper's alternate, not the conditions proposed by Southern California Edison in it's March 24th letter to Cmmr. Conlon. Summary: On March 24, 1998, Phyllis Huckabee, Director, State Regulatory Relations for Southern California Gas Company, initiated a telephone conversation with Julie Halligan, advisor to Cmmr. Bilas. Thomas Brill, Director, Regulatory Law for Pacific Enterprises; Brian Cherry, Regulatory Proceedings Manager, and Lad Lorenz, Director, Capacity and Operational Planning, for SoCalGas; and Lee Schavrien, Regulatory Affairs Director for San Diego Gas and Electric Company, also partcipated. Lorenz stated that SoCalGas is willing to post on its Gas Select bulletin board, every hour within the hour, interstate deliveries on a receipt point basis, as well as hourly storage flow rates. Lorenz explained that SoCalGas already posts daily information including: (1) estimated day before, (2) actual day, and (3) next day flows. Lorenz stated that the value to the market of hourly information is likely to be limited because system flow requirements provide only two opportunities to change deliveries on any given day. Lorenz noted that customers already have the opportunity to make changes between 7:30 a.m. and 9:00 a.m. each day after seeing the 7:30 a.m. daily information postings. Brill stated that SocalGas is committed to giving the market the best information available. Brill stated further that SoCalGas supports adding language to the merger decision which indicates that this case does not prejudge the market power issues being examined in the Commission's gas strategy rulemaking.
