GLOSSARY After January 1, 1998, the California Public Utilities Commission is required by statute (SB 960) to categorize each case that comes before it. There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. RS Ratesetting proceedings are proceedings in which the Commission sets or investigates rates for a specifically named utility (or utilities), or establishes a mechanism that in turn sets the rates for a specifically named utility (or utilities). Ratesetting proceedings include complaints that challenge the reasonableness of rates or charges, past, present, or future. N/A Removed from the SB 960 category requirements. Summary: On April 8, 1998, Bruce Foster, Vice President for Southern California Edison Company (Edison), met with Cmmr. Neeper in San Francisco. Also present were: David Gamson, advisor to Cmmr. Neeper; and Russell Worden, Regulatory Affairs Manager for Edison. The Edison representatives stated that when a customer's incremental load is served by an alternative generator, that generator's operation is dependent upon the local utility for services such as synchronization, provision of in-rush current and "Black Start" operation. The Edison representatives further stated that of the 60 synchronous cogenerators connected to the Edison system, only one has "Black Start" capability. The Edison representative stated that because these generators rely on the Edison's Transmission and Distribution system, section 369 does not exempt any new or incremental load they serve from the Competition Transition Charge. The Edison representatives further stated that the leading advocates of expanding the Section 369 exemptions are the same parties responsible for Edison's uneconomic costs, 70 percent of which is the product of Qualifying Facilities contracts. McCallion indicated that GTE is willing to participate in this proceeding and that GTE supports most of the phase one proposals presented by Pacific Bell with the exception of freezing the basic residential service rates for three years. Representatives of GTE expressed concern with its ability to support the provision of a below cost service at existing rates while the subsidies embedded in the other services will be eroded due to competitive pressure. McCallion also indicated that pricing flexibility is critical to GTE and urged the Commission to institute the phase two proceeding as soon as phase one is concluded.
