There are three categories, quasi- legislative, adjudicatory and ratesetting. If a case does not require hearings before it is resolved, the case is removed from the SB 960 category requirements. The legend below shows the abbreviation for each of the categories and provides a brief explanation. Q Quasi-legislative proceedings are proceedings that establish policy or rules (including generic ratemaking policy or rules) affecting a class of regulated entities, including those proceedings in which the Commission investigates rates or practices for an entire regulated industry or class of entities within the industry. A Adjudicatory proceedings are: (1) enforcement investigations into possible violations of any provision of statutory law or order or rule of the Commission; and (2) complaints against regulated entities, including those complaints that challenge the accuracy of a bill, but excluding those complaints that challenge the reasonableness of rates or charges, past, present, or future. Chong further stated that the key issue, involved in the SBC filing, is the limitation of local competition, not the expansion of long distance competition. Chong described the possibility of future Local exchange carriers involvement in the long distance market as a powerful incentive for the SBC- Pacific Bell (PacBell) cooperation in the opening of the local market to competition. Chong stated that premature BOC entrance into the long distance market, however, would dissolve that incentive, delay local competition for several years, cripple or drive local competitors out of the market, and injure the consumer.
