Public Meeting - NXX Code Lottery Workshop February 25, 1999 State Building 9 am - 4 pm 455 Golden Gate Avenue Conference Rooms 2 and 3 San Francisco The Telecommunications Division of the California Public Utilities Commission will be holding a third technical workshop on fine-tuning the NXX Code Lottery held each month at the CPUC. Decision 98-08-037 found there is a need for a fresh review of lottery procedures. In this third workshop, the lottery process will be reviewed to determine if there are ways to make the distribution of NXX codes among carriers more equitable, and more conducive to the development of competition. Specifically, the topic of increasing the percentage of initial codes assigned from the lottery from the current 60% to a higher amount will be explored. Participants should come prepared to address potential reform measures for the lottery, identify potential shortcomings and suggest ways to revise the lottery process to promote a more competitive market including potential revisions in the allocation between initial and growth codes. The PacBell representatives were Bill Blase, Jim Young, and David Discher. PacBell initiated the contact. Notwithstanding the recent Supreme Court decision in AT&T v Iowa Utilities Board, Mr. Young stated there are four (4) reasons why the Commission need not change its existing decision requiring simultaneous inter LATA and intraLATA entry. He further stated that in accordance with AB 1890, transition costs should be allocated among the customer classes based on allocation of non- economic generation costs contained in the June 1996 rates approved by PUC. He said the Legislature in its hearings leading to AB 1890 rejected proposals recently offered by the Office of Ratepayer Advocates ("ORA") to allocate costs using generation marginal costs. Instead, Mr. McCrea stated, the Legislature adopted the allocation used in the June, 1996 rates, i.e. full EPMC. Bilas, in San Francisco. Frank stated that there are no market power concerns related to the sale of PG&E's fossil power plants to Southern Energy, and that the Commission should not delay approving the sale. Frank noted that after the sale is complete, Southern Energy will not be the largest holder of generation in California; that PG&E still owns approximately 9,000 MW of undivested generation. Frank indicated that the earlier power plant auctions have resulted in other independent power producers with a greater share in generation. Frank stated further that the Delta and Portero plants are subject to the must-run contracts; therefore they cannot exercise market power because they are needed for reliability. In addition, Frank stated that the 30-day notice provision, under Hart-Scott- Rodino, has been waived because the U.S. Department of Justice has determined that there are no market power concerns regarding this sale. Frank stated that the other provisions also exist to protect against the exercise of market power. Finally, Frank pointed out that Federal Energy Regulatory Commission will only grant authorization for a power plant owner to sell at market-based rates if the applicant does not have market power.
