Decision 98-08-037 found there is a need for a fresh review of lottery procedures. In this third workshop, the lottery process will be reviewed to determine if there are ways to make the distribution of NXX codes among carriers more equitable, and more conducive to the development of competition. Specifically, the topic of increasing the percentage of initial codes assigned from the lottery from the current 60% to a higher amount will be explored. Participants should come prepared to address potential reform measures for the lottery, identify potential shortcomings and suggest ways to revise the lottery process to promote a more competitive market including potential revisions in the allocation between initial and growth codes. Summary: On January 27, 1999, in two (2) consecutive meetings Southern California Edison ("SCE") representatives engaged in oral and written ex parte communications at CPUC with (a) Commissioner Neeper and advisor David Gamson, and (b) Commission President Bilas and advisor Dorothy Duda. The representatives were Bruce Foster and Alan Fohrer. The content of the communication was the same in each meeting. Mr. Foster described the performance based ratemaking ("PBR") procedure authorized in D96-09-092. Details of those procedures were then related. Mr. Foster went on to state the limited purpose for SCE's participation in this proceeding was to review generic issues related to unbundling cost of capital. Mr. Foster stated that ongoing efforts of other parties to broaden the proceeding would violate the automatic adjustment feature of the Commission's trigger mechanism earlier described as authorized in D96-09-092. It was stated that in respect to the alleged unbundling discount, the record clearly shows the UDC is not less risky than the former integrated utility. SCE said that this conclusion was reached by the administrative law judge ("ALJ"), and that accordingly, the Commission should not change SCE's return on equity and should allow the trigger mechanism to continue to operate as originally intended. Mr. Foster then discussed these factors as they pertain to Pacific Gas & Electric ("PG&E") and Southern California Gas ("SoCalGas"). Mr. Fohrer then discussed the history of the Commission's cost of capital decisions for SCE and SoCalGas. He concluded by saying historical treatment of electric and gas utility returns provides further support to the ALJ's conclusion that the UDC is not less risky than the former integrated utility now that the generation function has been removed. On January 28, 1999, John P. Hughes of Southern California Edison ("SCE") engaged in oral ex parte communications at CPUC with two (2) PUC officials in consecutive meetings. The content of the communications was the same in each meeting. The first meeting was with Commission President Bilas, and the second with Michelle Cooke, advisor to Commissioner Duque. Present at each meeting was Tom Thompson of the Office of Ratepayer Advocates ("ORA") and another SCE representative. SCE and ORA jointly initiated the meetings. SCE stated the method of sharing gross revenues was preferable to a net method since ratepayers would be guaranteed a revenue "stream" even if SCE shareholders were losing money on a given enterprise. SCE further stated the settlement in the proceeding is consistent with prior Commission decisions on revenue sharing mechanisms. SCE additionally made the point that hearings were unnecessary. The meeting concluded with SCE and ORA urging approval of the settlement as soon as possible. Summary: On February 5, 1999, James Scarff, attorney for the Office of Ratepayer Advocates (ORA), met with Michelle Cooke, advisor to Cmmr. Duque, in San Francisco. Also present were: Chris Danforth, project manager, and Robert Kinosian, analyst, for -ORA. ORA noted the distinction drawn in the scoping memo between market valuation of hydro resources for calculation of the transition charge and final disposition of the asset. ORA commented that consideration of any interim valuation of hydro and coal assets must consider the ratemaking consequences of such a valuation. ORA stated its position that the Commission should not act in an interim valuation in a way that forecloses desirable long-term disposition options. ORA also stressed the need to have any California Environmental Quality Act review occur before the Commission acts in a way to create environmental impacts, and that such a triggering action may be an interim valuation of the assets for transition cost purposes rather than the final section 851 or 377 filing. Finally, ORA stated that it saw nothing in AB 1890 which exempted nuclear plants from the requirement that they be market valued. Summary: On February 8, 1999, William Bagley of Nossaman, Guthner, Knox & Elliott, LLP, counsel for California Water Association, wrote a letter (attached to the notice) to Cmmr. Duque. A copy of the letter was also delivered to ALJ Bennett. The letter responded to letters from plaintiffs complaining about the Commission's procedures followed at the second prehearing conference and about a pleading suggesting scoping memo concepts. Bagley explained in the letter that the referenced pleading was proper and noted the unfamiliarity of plaintiffs' counsel with Commission procedures.
