The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. ("AT&T") initiated oral and written ex parte communications at CPUC with Commissioner Neeper and advisor Fassil Fenikile. The representatives were Rick Witherington and Bob Kargol. Richard Severy of MCI WorldCom was also present. AT&T stated support of the administrative law judge's proposed decision. Mr. Kargol and Mr. Severy stated Commissioner Neeper's alternate decision fails to address evidence of Pacific Bell's ("PacBell") planned use of improper marketing practices. They also stated that the total billed revenue ("TBR") information available to PacBell could be used by them to market long distance service in an anti-competitive manner. Mr. Severy concluded by pointing out PacBell had previously been found to have misappropriated carrier proprietary information in marketing efforts. She advised that the PD adopted the position of the Office of Ratepayer Advocates ("ORA") that the windloading factor for Pacific Gas & Electric poles should be higher than that used for other utility poles. In view of that, Ms Lehtonen stated CCTA will likely file a petition to intervene in order to comment on the PD. Summary: On February 2, 1999, Pacific Bell ("PacBell") told Commission President Bilas at CPUC that the Commission should not delay arbitration or wait on an order from the Federal Communications Commission on reciprocal compensation. To do would be inconsistent with an earlier PUC decision on Internet traffic, PacBell said. This communication occurred during an "all party" meeting initiated by Pac-West. Present at the meeting were the PacBell representatives, Ron Sawyer, Dan Jacobsen, and Jim Young, as well as four (4) representatives from Pac-West and three (3) members of the PUC staff. PacBell added that Pac-West entered into negotiations under the framework of the Federal Telecommunications Act based on mutual agreement on a window and other actions, and that Pac-West should be estopped from changing its position. Wong addressed the 1999 U.S. Supreme Court decision in AT&T v Iowa Utilities Board. After citing certain elements of the decision, Ms Wong proposed a five (5) part package under the assumption that the Federal Communications Commission will issue new and final rules in light of the aforesaid decision. She continued ".until the legal landscape is settled, GTE's proposal as described above would maintain the status quo, and the parties can proceed with business as usual until the issues presented by the court's ruling are resolved." Ms Wong concluded with the statement "GTE is not asking the Commission to take any action at this time. Rather, GTE is notifying the Commission that it will negotiate `status quo" arrangements with all affected CLECs in accord with the above terms." Summary: On February 18, 1999, Roseville Telephone Company ("Roseville") sent PUC officials a copy of a letter simultaneously sent to the Office of Ratepayer Advocates ("ORA"). Commission President Bilas received the letter as did his advisors and the administrative law judge. In its letter addressed to Andrew Ullmer of ORA, Roseville expressed disagreement with the foundation of any audit of Roseville as earlier initiated by ORA. In the nearly two (2) page letter, E. Garth Black of Roseville states "It appears that ORA simply does not wish to acknowledge what the Commission has made perfectly clear: If Roseville and ORA disagree, a verification audit will not go forward until the Commission decides it should." In the letter Roseville also expressed objections to the ORA method of signing "an unreasonably expensive contract with a particular consultant to conduct an audit that had not even been ordered" and noted ORA's unresponsiveness to Roseville's request for ORA records under the "Public Records Act" as to how the consultant was selected and the process of issuing requests for proposals ("RFP") to select the consultant. Mr. Black concluded by saying if indeed the Commission orders an audit, that the process of selecting an audit consultant must begin anew.
