NOTICE OF DRAFT RESOLUTIONS (Pursuant to PU Code  311(g)) Draft Resolution Approving Disclosure Of Information Concerning Utility Readiness With Respect To The Year 2000 Computer Problem, Including Utility Responses to Resolution M-4792, Dated November 19, 1998 Available For Public Review And Comment. A draft resolution (M-4793) of the Executive Division approving disclosure of information concerning utility readiness with respect to the Year 2000 (Y2K) computer problem, including utility responses to resolution M-4792, dated November 19, 1998, will be on the April 1, 1999 Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote until later. When the Commission votes on M-4793, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution. The draft resolution was circulated on March 2, 1999 to the Resolution M-4792 Service List, and to other entities, such as certain passenger stage corporations and vessel common carriers, who have been asked to provide information concerning their Y2K readiness. Utilities and other entities providing Y2K readiness reports to the Commission pursuant to Resolution M-4792 may request in comments to this draft resolution that certain limited portions of their Y2K readiness reports should be treated as confidential. Entities seeking confidential treatment should recognize the strong public interest in disclosure of Y2K readiness information, and should seek confidential treatment only if they can demonstrate to the Commission's satisfaction both that the portions they wish kept confidential fall within a specific exemption in the California Public Records Act (Government Code Section 6250 et seq.) and that the public interest in nondisclosure clearly outweighs the public interest in disclosure. An entity should not seek confidential treatment of any information which has been made publicly available through Y2K readiness reports filed by that entity with other agencies or through reports posted on the entity's web site. In addition to Claudine Swartz of Sempra, San Diego Gas & Electric's ("SDG&E") Vince Bartolomucci and Mike Strong conveyed communications to the advisor. Ms Swartz stated the proposed decision properly amends the distribution line loss factor and urged PUC to adopt use of generator meter multipliers to measure transmission line losses. Mr. Bartolomucci stated that the "GMM's" vary for each "QF" and appropriately reflect SDG&E's avoided costs. Mr. Strong noted that GMM's reflect alternative sources of generation and their physical location. Mr. Bartolomucci added that GMM's are reflected in the quantity of energy purchased from the Power Exchange and are therefore inherent in the price SDG&E pays for energy. Ms Swartz concluded by stating that continued use of SDG&E's current transmission line loss factors would increase transition costs. The communication was the same in each meeting. In the second meeting which was held at 1:30 p.m. 2/19/99 at CPUC, several other parties were present in addition to the PUC officials. The Sempra representatives were Kimberly Freeman and Lee Schavrien. The PUC official present at the first meeting held on 2/19/99 was Dorothy Duda, advisor to Commission President Bilas. The second meeting of 2/19/99 was attended by Commissioner Duque and his advisor, Michelle Cooke. Present at the third meeting on 2/23/99 were Commissioner Neeper and his advisor, David Gamson. Parties in attendance with Commissioner Duque included NRDC representatives Ralph Cavanagh, Barry Epstein, and Peter Miller; Michael Shames of UCAN; Jason Zeller and David Fukatome of Office of Ratepayer Advocates ("ORA"); Bob Weisenmiller of MRW; Andy Niven and Jasmin Ansar of Pacific Gas & Electric ("PG&E"), and Mike Hoover of Southern California Edison. Sempra through Mr. Schavrien stated that the proposed decision ("PD") is inconsistent with the Commission's stated PBR policies in many respects. The PD, he said, contains oversights and errors in dealing with the indexing mechanism, earnings sharing formula, and productivity factors. Mr. Schavrien said SDG&E supports a rate indexing mechanism. The Commission, he stated, should consider the interaction of the indexing and sharing mechanism. He concluded by stating the proposed stretch factor penalizes SDG&E for its good performance during its last PBR period, and that the PD requires an extensive overhaul. The City's position, he said, is one of wanting a tough but fair outcome in this proceeding and that any situation in which perverse incentives existed at the Sempra level should be avoided. Present were representatives from the National Resources Defense Council ("NRDC"), Utility Consumer Action Network ("UCAN"), MRW consulting firm, Pacific Gas & Electric, and Sempra Energy. ORA, represented by Jason Zeller and Dave Fukutome, conveyed several points, as follows. Evidence in the proceeding supports a 1% stretch factor of productivity growth for electric distribution utilities. San Diego Gas and Electric's ("SDG&E") proposed sharing mechanism has never been used by any utility commission thus far. Utilities should be rewarded if they achieve productivity above forecasted levels. ORA supports rate indexing because it would be less likely to lead to problems with stranded utility distribution rate-base. The proposed decision's adoption of a revenue per customer cap eliminates that incentive, and therefore alleviates ORA's concern about giving SDG&E an incentive to increase load in its service territory.
