Les Guliasi of Pacific Gas & Electric ("PG&E") initiated consecutive ex parte sessions at CPUC with (a) Commissioner Duque and advisor Tim Sullivan, and (b) Commission President Bilas and advisor Dorothy Duda. Communications conveyed were the same in each meeting. Mr. Guliasi raised the issue of PG&E's service restoration efforts following the severe winter storms of 1995, and said PG&E's restoration efforts compared favorably with other utilities in responding to storms of comparable severity. Mr. Guliasi further stated the proposed decision's ("PD") findings that PG&E's conduct was unreasonable in its handling of customer claims was not supported by the record. Mr. Guliasi, citing the PD's three (3) allegations of negligence against PG&E, responded that the company always abided by Rule 14 in handling customer claims. In support of his assertion, the PG&E representative provided the PUC officials copies of claims processing documents that PG&E used and further submitted for the record in this proceeding (and which were attached to the Notice of Ex Parte Communications). He said the PD's recommendation to record all claims paid as a "below the line" expense is unfair and would represent an unprecedented deviation from PUC practice. Mr. Guliasi concluded by saying the PD unfairly applies a more stringent pole loading standard to PG&E compared to other energy and telecommunications utilities. The letter, signed by Les Guliasi, stated that PG&E's proposal to continue to set revenue cycle service credits equal to the utility's geographically-averaged short run avoided costs is consistent with PUC's objective of reflecting the utility's true cost savings when the utility does not provide the service. Summary: On March 5, 1999, Pacific Gas & Electric Co. ("PG&E") wrote a letter to all of the commissioners, their advisors, other PUC officials, and parties of record on the service list. The letter, signed by Les Guliasi, stated that PG&E's application includes testimony on marginal cost, revenue allocation, and rate design proposals. Marginal cost details were listed. The letter further stated PG&E is proposing base revenue allocation on an equal percentage of distribution and customer access marginal costs, the use of System Average Percentage methodology for CTC revenue allocation; and the consolidation of rate schedules into eight classes for revenue allocation. Regarding residential customers, the letter stated PG&E's proposal includes a $5.00 customer charge to replace the current minimum bill of $5.00 per month and continuance of the 25 percent employee discount after the freeze. The letter concludes by stating PG&E's projects will have significant rate decreases for all customer classes, ranging from 11 to 43 percent from currently discounted rates showing that the rate freeze, mandated by AB 1890, is working. Summary: On March 9, 1999, Roseville Telephone Co.("Roseville") initiated a meeting at CPUC with Dr. Tim Sullivan, advisor to Commissioner Duque, and therein conveyed oral ex parte communications. Roseville representatives conveying the communications were Mr. Michael D. Compbell and Mr. Greg R. Gierczak. They said Roseville's objections to the audit proposed by Office of Ratepayer Advocates'("ORA") were not primarily about the audit itself, but about process that led to the improper selection of and contracting with Overland Consulting. Roseville stated this occurred before ORA had any authority to do so. Other points made were that the scope of the audit far exceeded that described in the general rate case and holding company orders and that the audit's cost is greater than it should be. Roseville also said the process used to select the consultant was improper in that the low bidder was excluded from consideration. Roseville concluded by saying PUC should require ORA to re- start the process if it determined that an audit should begin now. ("PG&E") initiated ex parte communications to Dorothy Duda, advisor to Commission President Bilas. On 3/11/99 Mr. Rubin telephoned Ms Duda and stated that performance based ratemaking ("PBR") mechanisms for California's other energy utilities (SoCalGas, SDG&E, SCE) are based on rate of return, and thus are net sharing mechanisms. He stated a belief that the tax treatment for SDG&E's 1993 PBR is identical to the treatment PG&E has proposed in its PBR, and thus is consistent with PG&E's new non-tariffed products and services proposal. He added that the Diablo Canyon decision D97-05-088, conclusion of law "10," specified a net sharing mechanism after the end of 2001. The following day, 3/12/99, Mr. Rubin faxed to Ms Duda copies of pages 4-6 through 4-9 from PG&E's PBR application, A98-11-023. Summary: On March 15, 1999, Mark Savage of Public Advocates, Inc., initiated a meeting with Commissioner Duque and his advisor, Timothy Sullivan. Mr. Savage was representing a group he called the "Intervenors," consisting of the Southern Christian Leadership Conference, National Council of La Raza, Korean Youth and Community Center, Filipinos for Affirmative Action, and Filipino Civil Rights Advocates. Mr. Savage expressed appreciation for the commissioner's alternate order ("AO") on the Intervenors' request for compensation. Mr. Savage said there had been a good faith misunderstanding about counsel's failure to provide the requisite matrix allocating costs required by the order. In regard to the AO's reference to "costs," Mr. Savage said his original understanding of the term meant out of pocket costs, and not a breakdown of "fees." In answering questions, Mr. Savage stated his understanding that Pacific Bell had filed comments on the AO, which had taken the position that Pacific Bell was not the subject of the proceeding and therefore not obligated to pay the award. He said both the incumbent and competitive local carriers participated in the proceedings leading up to D96-10-076, and that the decision had addressed requirements governing the competitive local carriers and had deferred consideration of requirements governing incumbent local carriers. Mr. Savage concluded by saying D98-04-059 and D99- 02-039 addresses PUC jurisdiction to determine which utilities are subject to proceedings and which ones are obliged to pay awards of compensation. Summary: On March 10, 1999 Kristel Frank of Pacific Gas & Electric Co. ("PG&E") telephoned Dorothy Duda, advisor to Commission President Bilas. She said the proposed decision changes the treatment of environmental remediation costs previously adopted in D98-07-092. Ms Frank stated the Commission approved the same accounting and ratemaking treatment in that decision as was approved for PG&E's Wave I power plant sales in D97-09-046. She added no party had protested or raised any issue with PG&E's proposed ratemaking treatment of these costs in this proceeding. Ms Frank explained the proposed change to the ratemaking treatment, which would establish a balancing account to be credited to the Transition Cost Balancing Account, could not be implemented. She said PG&E has assumed the environmental liabilities associated with the plants, and that the costs would be incurred over a 20 to 30 year time frame. PG&E hired environmental consultants, Ms Frank said, and developed detailed net present value estimates of the costs not unlike the estimates which were just deemed reasonable in SDG&E's divestiture proceedings. She concluded by saying there was no reason for PUC to change the ratemaking treatment for these costs. The letter referenced a previous ex parte session on 3/9/99 and the proposed decision ("PD") on the audit of Roseville. Among the statements in the letter, which was addressed to Commission President Bilas: "We were concerned to hear that your office was of the belief that the audit was to encompass a review of Roseville's operations and NRF. This is not true." Another passage read: "I would like to reaffirm our discussion that this dispute is not about an audit. It is about ORA's refusal to comply with the specific steps and scope of the audit as ordered by the Commission." Attached to the letter were a five (5) page summary and selected excerpts of D.96-07-059 and D.96-12-074 in support of Roseville's contentions. The last statement in the letter was as follows: "The Commission's decisions are very clear in identifying that the verification audit is limited to a review of Roseville's affiliate and non- regulated transactions, and the enclosed material supports this basic principle." Summary: On March 11, 1999, J.B. Callaway, President of the Pacific Telesis Group, and on behalf of Pacific Bell ("PacBell") sent a letter to Commission President Bilas and provided copies of the letter to the other commissioners and certain PUC staff. Mr. Callaway's letter made reference to consumer groups that intensely criticize PacBell for proposing operator service rate increases-while at the same time AT&T has "quietly raised rates for several operator and calling services well beyond what Pacific Bell charges." In support of his position, Mr. Callaway attached news articles and other documents in reference to those AT&T actions, suggesting the commissioners would find the information interesting. Mr. Callaway concluded: "We will be most interested to see whether the aforementioned `consumer' groups pursue these.(AT&T).price changes/proposals to customers with the same fervor that they traditionally reserve for Pacific Bell." ("PG&E") initiated an ex parte meeting with David Gamson, advisor to Commissioner Neeper. Present for PG&E were Sabrina Miller and Robert McLennan. Accompanying the PG&E representatives were Dale Sartor from Lawrence Berkeley Laboratory and Maric Munn of the Presidio Trust. Mr. McLennan called attention to D94-04-039 and the decision's finding that the Presidio contract was reasonable. He refuted the Office of Ratepayer Advocates ("ORA") assertion that the Presidio's gas boiler replacement project would have been completed without the PG&E contract. He cited government funding restrictions at the time as basis for the assertion. Mr. Sartor said 1990 was used as the baseline year in calculating the energy savings for the retrofits. He said despite claims to the contrary, it is not true that PG&E and the Presidio are claiming energy savings from the Presidio closure. Savings are primarily the result of reduction in distribution system losses associated with an aging central plant. The financial incentives provided under the DSM contract influenced the Presidio to take on the retrofit project according to Mr. Sartor; otherwise the federal government would not have funded it. Institutions such as UC Berkeley, said Mr. McLennan, install cogeneration at their central plants without any capital expenditures and have contractors finance, design, build, and operate the plants. Mr. Sartor stated such institutions do not achieve energy savings as in the Presidio project. DSM payments are not a substitute for federal dollars that would have been spent anyway, said Mr. Sartor, and that DSM payments will incrementally enhance the energy management program at the Presidio. She said PG&E's it was proposed in its Wave I sale to duke and approved at that time, and that a similar treatment was recently approved for the sale of the SDG&E plants. D.98-07- 092 adopted the treatment, she said, and that no party protested it in either in this case or PG&E's Wave I divestiture proceeding. Mr. Malkin stated that the cost estimates for environmental remediation are based on net present value estimates consistent with PUC's Competition Transition Charge decision 97-11-074. He further stated since PG&E is retaining the environmental remediation associated with these facilities, the utility will be required to perform that remediation to the satisfaction of the appropriate agencies even if standards change from current levels Ms Everett concluded by saying that PG&E's cost estimates were provided by their consultant, Fluor Daniel, and that the utility had agreed to retain environmental responsibility in perpetuity.
