I95-02-015 Commission Order Instituting Investigation into rates, charges, service and practices of PG&E. Summary: CORRECTION FROM THE DAILY CALENDAR OF 3/26/99. On March 3, 1999, Les Guliasi of Pacific Gas & Electric (“PG&E”) initiated an ex parte session at CPUC with Commissioner Neeper and advisor David Gamson. Mr. Guliasi raised the issue of PG&E’s service restoration efforts following the severe winter storms of 1995, and said PG&E’s restoration efforts compared favorably with other utilities in responding to storms of comparable severity. Mr. Guliasi further stated the proposed decision’s (“PD”) findings that PG&E’s conduct was unreasonable in its handling of customer claims was not supported by the record. Mr. Guliasi, citing the PD’s three (3) allegations of negligence against PG&E, responded that the company always abided by Rule 14 in handling customer claims. In support of his assertion, the PG&E representative provided the PUC officials copies of claims processing documents that PG&E used and further submitted for the record in this proceeding (and which were attached to the Notice of Ex Parte Communications). He said the PD’s recommendation to record all claims paid as a “below the line” expense is unfair and would represent an unprecedented deviation from PUC practice. Mr. Guliasi concluded by saying the PD unfairly applies a more stringent pole loading standard to PG&E compared to other energy and telecommunications utilities. He said any such standard should apply to all utilities and not be applied merely to PG&E in this proceeding. The occasion was a meeting conducted at CPUC at the initiation of NRDC. Other parties represented at the meeting were UCAN, the City of San Diego, and Office of Ratepayer Advocates (“ORA”). Attending for Sempra were Ed Guiles, President of San Diego Gas and Electric (“SDG&E”) and Bill Reed, Lee Schavrien, Lisa Hubbard, and Kimberly Freeman, all of SDG&E. Mr. Guiles said SDG&E agrees that the proposed alternate decision of Commission President Bilas is simple, relevant, and compatible with the competitive market. He urged the Commission to adopt the rate indexing methodology, and stressed that demand side management (“DSM”) was a core value at SDG&E. Mr. Reed added that in 1997 and 1998 SDG&E operated without ERAM protection, yet did not have egregious sales growth programs. Mr. Schavrien said SDG&E opposed a 4/30/99 end date for the gas fixed cost account (“GFCA”) as this termination date may result in a shareholder impact of roughly $30 million. Due to over-collection and under-collection at different times of the year, Mr. Schavrien urged PUC to consider a January end date for the GFCA. He also recommended the Commission reconsider the deadband in the earnings sharing mechanism, stating that it should be at last 100 basis points wide. They were that (1) ratepayers would be harmed in that they would not be compensated unless PG&E made a profit, (2) reporting, accounting, and auditing details in the AD are insufficient to determine the reasonableness of revenues, costs, and profits for purposes of determining ratepayers’ profits, and (3) the AD relies to some degree on the interim nature of PG&E’s proposal. Sempra representatives in attendance were Ed Guiles, President of San Diego Gas & Electric (“SDG&E”), and Bill Reed, Lee Schavrien, and Kimberly Freeman. Mr. Reed stated that adoption of language currently in the proposed decision (“PD”) could inhibit Sempra’s ability to move forward with strategic and financial plans. He said uncertainties caused by the draft decision could send unnecessary signals into the market to negatively impact Sempra’s market value. He concluded by stating the Commission should avoid policies preventing California companies from pursuing growth opportunities in out of state investments.
