Mr. Guliasi said four (4) issues addressed in the proposed decision ("PD") should be changed. Ms Mason said there is no need for an order instituting an investigation into the financial conditions of the state's energy utilities. Ms Mason further stated that the PD order of a verification audit of PG&E is both unnecessary and unfair. Reasons were cited. If there is such an audit, she said, its responsibility should lie with the Energy Division and not the Office of Ratepayer Advocates. Ms Mason said the next matter should be to reject the PD's document retention order imposed on PG&E in favor of the order previously adopted in Phase I of the proceeding. Other representatives in attendance were from the Natural Resources Defense Council ("NRDC"), Utility Consumer Action Network ("UCAN"), Pacific Gas & Electric Co., California Energy Markets, Southern California Edison, San Diego Gas & Electric Co. ("SDG&E"), and Sempra Energy. ORA attendees were Jason Zeller, Bill Gibson, and Dexter Khoury. ORA told Commissioner Duque that Commission President Bilas' alternative order is flawed because it gives SDG&E an incentive to increases sales, this notwithstanding the alternative adopts rate indexing and that ORA favors rate indexing. Providing details in justification, ORA then contended that either the decision should be modified to de- couple sales from revenues or the original proposed decision should be adopted because the revenue per customer cap gives SDG&E no incentive to increase sales. ORA then cited figures illustrating that both the proposed decision and the alternative have an appropriate sharing formula. ORA concluded by providing reasoning why the gas fixed cost account ("GFCA") should be ended on 4/30/99. He said PUC should adopt rate indexing methodology because it encourages cost effective use of SDG&E's distribution system. Demand side management ("DSM") is a core value at SDG&E, Mr. Guiles added. The AD's PBR mechanism provides the right price signals to the market place, Mr. Guiles concluded. Mr. Reed stated SDG&E opposed a 4/30/99 end date for the Gas Fixed Cost Account ("GFCA") because it may result in a shareholder impact of roughly $30 million. He urged to Commission to implement a January end date for the GFCA, citing the collection disparities between the first four (4) months of the year and the remainder of the year. The Commission should also re-consider the deadband that has been set for the earnings sharing mechanism, Mr. Reed said. The deadband should be at least 100 basis points wide, he said, and that it should capture the normal operating conditions of the utility. Ms Frank further stated that PG&E proposed the surplus between the accrual for environmental and non-environmental clean up costs be credited to the remaining fossil plant rate base. This ratemaking was approved previously by PUC for the Wave I plants, Ms Frank said, and that no party opposed it, and further that no party commented that the alternate to the PD should be revised. She added that $8.8 million of the $48.5 million in surplus is geothermal surplus, and that PG&E proposes the $8.8 million be credited to the Transition Cost Balancing Account ("TCBA") while the remaining $39.7 would be credited to the remaining fossil generation plants. She said the surplus would be credited to decommissioning/dismantling reserve for plants at Humboldt Bay, Hunters Point, and Kern, adding that the Kern Power Plant is decommissioned but not yet dismantled. PG&E had been authorized, she said, to collect approximately $83 million for decommissioning the plants. As of 12/31/98 $38 million had been amortized, Ms Frank said, leaving $45 million for future amortization. Ms Frank said the $39 million surplus would reduce that amount if PG&E's proposed ratemaking were adopted. If the surplus exceeds the amount remaining to be amortized, she said, it would be credited to the Transition Cost Balancing Account.
