On three (3) occasions in February, Sempra Entergy ("Sempra") representatives conveyed to PUC officials that San Diego Gas & Electric ("SDG&E") would likely end its rate freeze in June of this year as a result of actions taken by SDG&E to pay down its competitive transaction costs ("CTC") and the status of the current CTC balance. The 3 meetings were held on 4, 9, and 10 February, 1999, respectively, with (1) Commissioner Neeper, (2) President Bilas and his advisor, Dorothy Duda, and (3) Commissioner Duque and his advisor, Michelle Cooke. The composition of the Sempra contingent differed slightly from meeting to meeting. For the 2/4/99 meeting, Kimberly Freeman, Lee Schavrien, and Bill Reed attended. The same contingent less Mr. Schavrien attended the 2/9/99 meeting. Sempra also stated the following: that actions to end the rate freeze include crediting any gain on the sale from Station "A" and South Bay power plants to CTC and requesting the transfer of any 1997 and 1998 PBR revenue sharing amounts to be credited to CTC. The Sempra representatives added that filing to end the rate freeze would be done soon. The proposed schedule for the filing was provided each PUC official, and the Commission was then urged to consider the timing of a decision on the application. A chart was also provided each PUC official comparing electric rates for various customer classes to illustrate what the rates looked like before and what they may look like after the rate freeze. Ms Hapner said PG&E has continued to support direct access implementation and has made very effort to accommodate changes to the new market. She said the parties spent a lot of time on settling, and that PG&E is dismayed with the denial of the settlement. Mr. Manheim said that while TURN and Enron filed limited objections to the settlement, neither suggested that it should be rejected. He added PG&E's due process rights will be violated if the Commission denies settlement and subjects PG&E to the outcome of a case litigated by another utility. Mr. Manheim further discussed guidelines in the Southern California Edison proposed decision and options in the PG&E settlement. He continued by stating if ineligible costs are allocated to "the market" through direct fees, that costs would be high enough for each individual direct access customer to negatively affect the direct access market. Mr. Manheim concluded by stating the proposed decision does not appear to allow recovery of procurement costs from bundled customers through a PX surcharge. Mr. Rubin further added the company's semi annual filing of revenues and costs associated with all products and services is the appropriate forum for routine reporting. He concluded by saying that a net revenue sharing mechanism is consistent with Rule VII of the affiliate transaction rules, despite ORA's contrary assertion in their comments on the AD. Mr. Sumpter stated there were four problems with the draft decision: (1) eliminating the ability of local exchange carrier (LEC) billers to disconnect local for non payment of toll, (2) mandatory implementation of the un-adopted workshop report from the FCC on "cramming best practices," (3) requiring a unique, California specific carrier identifier on the carrier's bill page, and (4) limiting the exercise of customer letters of authorization (LOA's) to within 30 days of the date of signature. Ms. Nail stated these proposals harmed competition. The seven (7) page written packet provided the commissioner amplified each of the aforesaid problem areas. The occasion was an "all party" meeting. Parties sending one or more representatives included Southern California Edison Co.("Edison"), Pacific Gas & Electric Co. ("PG&E"), San Diego Gas & Electric Co. ("SDG&E"), The Utility Reform Network ("TURN"), Energy Producers and Users Coalition ("EPUC"), California Association of Cogenerators ("CAC"), California Industrial Users ("CIU"), California Large Energy Consumers Association ("CLECA"), University of California/California State University systems, and California Manufacturers Assoc. ("CMA"). ORA was represented by Jonathan A. Bromson, Christopher Danforth, and Sean Casey. ORA stated the proposed decision of Administrative Law Judge Minkin and the alternate decision of President Bilas both misread PU 376 as requiring that all restructuring costs, and not just restructuring implementation costs, received "376 treatment" to be recoverable at all from bundled ratepayers. ORA stated the utilities should have the opportunity to recover reasonable, ongoing restructuring related costs that benefit the furtherance of a competitive electric generation marketplace. Such costs, ORA stated, would not merit "376" treatment. ORA added that the proposed decisions would prevent the utilities from having a realistic chance of recovering necessary costs, perhaps causing utilities in the future to curtail programs that would benefit the market. ORA postulated the Commission would not have found the PG&E and SDG&E settlements to be unreasonable had it accepted the principle that restructuring costs were not only "implementation" costs and could be recovered from ratepayers under certain circumstances.
