("SoCalGas") represented by Sempra Energy ("Sempra") officials initiated ex parte communications at CPUC with Commission President Bilas and his advisor, Dorothy Duda. The Sempra representatives David B. Follett, Judith L. Young, Lisa J. Hubbard, and Kimberly Freeman. President Bilas was told SoCalGas would file a writ of review with the California Supreme Court to seek to overturn D.99-03-026. Mr. Follett cited economic reasons why the decision was unsound, and then stated the company's grounds for judicial review. By limiting the rehearing, Mr. Follett related, SoCalGas denied SoCalGas any notice or opportunity to be heard after the Commission had reversed its findings in D97-04-082. Secondly, Mr. Follett said the Commission attempted to correct errors after the decision had become final, thus violating the prohibition against retroactive ratemaking. Third, Mr. Follet stated the Commission violated SB 1603 by considering natural gas industry restructuring policies before January, 2000. Summary: On March 29, 1999, MCI WorldCom ("MWCOM") initiated an ex parte meeting at CPUC with Commission President Bilas and his advisor, Lester Wong. MWCOM expressed concern over Pacific Bell's ("PacBell") proposed OSS plan. It was stated deployment and comprehensive testing of a Bell Operating Company's OSS is essential to the FCC's consideration of that firm's compliance with 271. OSS issues are being resolved effectively in New York, Mr. Lopardo stated, and that was one reason MWCOM entered the local residential market there. New York's approach enhances problem discovery and resolution, and hence system integrity, he explained. In contrast, omissions and deficiencies with PacBell's proposed OSS test plan were raised. Summary: LATE FILED. On March 25, 1999 William Reed of Sempra Energy ("Sempra") wrote a letter to Commissioner Duque. Mr. Reed stated that elimination of the "gas fixed cost account" ("GFCA") on 4/30/99 as proposed by the Office for Ratepayer Advocates ("ORA") will harm San Diego Gas & Electric Co. ("SDG&E") shareholders. While ORA's proposal was hypothetically sound in the abstract, Mr. Reed said, other factors exist which render the proposal unsound. One is that the GFCA was implemented on 5/1/88 with balances from previous accounts and not as a brand new item. Another was that calculation changes to the account were made in August of 1991. Another was that expenses and revenues must go through a full year's cycle to be in balance. Further details were cited. Mr. Reed concluded his letter by stating ORA's proposal does not reflect the reality and that the "birthday" for the GFCA should not be the deciding issue in resolving the matter. He asked for an extension of the 4/30/99 deadline imposed in the 2/5/99 Assigned Commissioner ruling regarding discretionary and non-discretionary fees. Mr. Guliasi stated the delay is being sought due to a possible change in the breadth of the proceeding due to the 3/11/99 proposed decisions ("PD") in the "Section 376" proceedings. He cited examples. Mr. Guliasi stated the different costing methods embodied by D97-10-087 and the PD's will create vastly different direct access fees. The correspondence was a 3/25/99 letter written to Commissioner Duque from Sempra's William L. Reed (and filed separately as Notice of Ex Parte Communication on 4/2/99). In the letter written to Commissioner Duque, Mr. Reed stated that elimination of the "gas fixed cost account" ("GFCA") on 4/30/99 as proposed by the Office for Ratepayer Advocates ("ORA") will harm San Diego Gas & Electric Co. ("SDG&E") shareholders. While ORA's proposal was hypothetically sound in the abstract, Mr. Reed said, other factors exist which render the proposal unsound. One is that the GFCA was implemented on 5/1/88 with balances from previous accounts and not as a brand new item. Another was that calculation changes to the account were made in August of 1991. Another was that expenses and revenues must go through a full year's cycle to be in balance. Further details were cited.
