Among the many points made: There are several problems with the proposed decision. It is unclear which activities SCE are required to perform. It is unclear which activities SCE may terminate. The PD in denying 376 recovery in favor or "market" recovery fails to define the market. Facts "29" and "72" raise several questions (and SCE lists them). The PD's defined role of the Utility Distribution Company ("UDC") is inconsistent with Commission decisions and reflects an incorrect view of UDC authority and responsibility. The PD should be modified to comport with previous PUC decisions and Assembly Bill 1890. Mr. Foster concluded by insisting the utilities must be allowed the opportunity to justify the reasonableness of the costs they incurred to implement direct access and comply with Commission decisions. Summary: On April 9, 1999 counsel for INFONXX, Inc., ("INFONXX") wrote a letter to Commission President Bilas, and provided a copy to Commissioner Neeper. John Clark's eleven (11) page letter described INFONXX's business as a competitive directory assistance ("DA") provider and explained the benefits that INFONXX and competitors have brought to consumers. Mr. Clark pointed out that the Commission's failure to establish nondiscriminatory, cost based pricing for such access has allowed the ILEC's to hinder fair competition by imposing egregiously high rates on DA service providers. Attached to Mr. Clark's letter was a Southern Bell cost study showing costs of DA database access as being orders of magnitude below rates now being charged by Pacific Bell. Also attached was a recent arbitration award by the Texas PUC establishing cost based rates for DA database access also well below those now being charged by Pacific Bell.
