Summary: On April 14 and 15, 1999, Pacific Gas & Electric Co. ("PG&E") initiated oral ex parte communications at CPUC with Dorothy Duda, advisor to Commission President Bilas. The PG&E representatives initiating the 4/14/99 meeting were Jana Corey and Dede Hapner. Ms Corey stated that PG&E would file joint comments the next day with parties to PG&E's settlement, stated support for Commissioner Neeper's alternative decision, and encouraged the Commission to vote out the decision at the 4/22/99 decision conference. Ms Corey also stated that TURN had agreed to support the settlement. The 4/15/99 communications consisted of a telephone call from Ms Corey to Ms Duda in which Ms Corey confirmed that the joint comments had been filed. Summary: On April 14, 1999 attorney Dan L. Carroll representing the Santa Maria Valley Water Conservation District (the "District") initiated an ex parte meeting at CPUC with Commissioner Duque. Attorney Brenda Jahns Southwick representing California Bureau Federation and Santa Barbara County Farm Bureau accompanied Mr. Carroll. Oral and written communications were conveyed. Mr. Carroll filed a four (4) page Notice of Ex Parte Communications representing oral statements he made to the commissioner, and a twenty eight (28) page packet comprising the handout provided the PUC official. Mr. Carroll and the District were responding to an ex parte meeting between Southern California Water Company ("SCWC") and Commissioner Duque on 3/23/99. The notice indicated the following point was made to Commissioner Duque: "The District's interest in the proceeding proceeds from its responsibility to manage the Santa Maria groundwater basin and its desire to see growth in the Orcutt area confront its own costs." Another point was that "SCWC had had four bites at the apple in its efforts to recover the costs of its ill advised participation in the State Water Project: (and it lists them).. Mr. Carroll said SCWC, not its ratepayers, should have to bear the cost of SCWC's poor business decision. He said SCWC's application should be denied with prejudice. Mr. Carroll then listed eight (8) reasons why the hearing record supports the proposed decision and refutes SCWC's assertions. Mr. Carroll concluded his oral presentation by stating SCWC's so called "Prudent Result" would be a fifth bite at the apple. Numerous points are made in the 28 page written packet. One headline reads "The Real Reason for This Application" followed by "to rescue SCWC from a horrible business decision." Summary: On April 14, 1999 the California Farm Bureau Federation and Santa Barbara County Farm Bureau (collectively "Farm Bureau") told Commissioner Duque that Southern California Water Company's ("SCWC") contention in this proceeding is not true. The filer contested SCWC's contention that it "needs to participate" in the State Water project to serve new growth in its service area. Other ways exist in which water can be provided to new development within SCWC's service, insisted the Farm Bureau. The Farm Bureau called attention to PUC policy that the cost of new facilities should be borne by customers for whose benefit new facilities are constructed. The Farm Bureau cited D92-10-056 to support their position. Accordingly, ALJ Walker's decision should be approved, Farm Bureau said, and SCWC's application dismissed with prejudice. The Farm Bureau was represented in this meeting by Brenda Jahns Southwick, a meeting initiated and attended by Dan Carroll, attorney for Santa Maria Valley Water Conservation District. Summary: On April 14, 1999 Southern California Edison Co. ("SCE") representatives initiated an ex parte meeting with Commissioner Neeper. SCE attendees were Bruce Foster and Michael R. Hoover. The commissioner was told SCE strongly disagrees with the proposed decision ("PD") of the administrative law judge issued on 3/11/99. Mr. Foster discussed the bifurcation between Phase I and II. He said despite the bifurcation, the PD would result in the wholesale disallowance of costs associated with activities SCE was mandated by the Commission to undertake in 1997 and 1998. This is unfair, SCE said, to deny SCE the opportunity to show reasonableness of costs after having been earlier ordered to perform them. Mr. Foster also stated the PD assumes a role for the Utility Distribution Company ("UDC") that has not been articulated before by PUC. The PD assumes the UDC is the same as any competitor and ignores SCE's special responsibilities Mr. Foster added. As a result of such faulty logic, Mr. Foster said the PD concludes market recovery is appropriate but never defines what the market is. Mr. Foster concluded by saying that despite the PD's disallowance of costs beyond 12/31/98, working groups and workshops continue for full implementation of direct access. Summary: On April 14, 1999, Southern California Edison ("SCE") told Commissioner Neeper that Commissioner Duque's alternate decision ("AD") was the proper decision to approve. While both the proposed decision ("PD") and the AD recognize there is no premium or discount associated with unbundling, SCE said, the AD correctly concludes the ROE ("return on equity") should not be changed. SCE's PBR has a trigger mechanism, the commissioner was told, that reflects changes in market conditions and any change from that decision as suggested by the PD would not be appropriate.. Mr. Schavrien stated there was a technical and factual error in the proposed decision ("PD") on the calculation of San Diego Gas & Electric's ("SDG&E") return on equity ("ROE") request He cited the transcript at page "1559." Correction of the error, he said, would equate to 11.8% ROE. Moreover, he continued, the correction would increase the recommended ROE from 10.6% to 10.77%. Mr. Schavrien then stated use of T- Bond rates rather than Aa Utility Bond rates is contrary to past PUC practice. Use of T-Bond rates, Mr. Schavrien insisted, compromises SDG&E's Market Indexed Capital Adjustment Mechanism ("MICAM"), as the MICAM is based on Aa Utility bond rates. Mr. Schavrien concluded by stating the Commission should consider the market volatility of the past six (6) months inasmuch as interests are almost 100 basis points higher today.
