Summary: On April 12, 1999, Southern California Edison ("SCE") told PUC advisors that Commissioner Duque's alternate decision ("AD") should be adopted. Advisors Dorothy Duda and Julie Halligan of Commission President Bilas' staff received that communication from SCE representatives Bruce C. Foster and John P. Hughes in a meeting at CPUC initiated by the utility. The proposed decision ("PD") erred, SCE said, in adjusting SCE's return on equity ("ROE") for market conditions. The representatives stated SCE's trigger mechanism in the AD was specifically designed to adjust for changes in economic conditions. In recognition of that, SCE said the AD properly concluded the utility should retain its 11.6% ROE. SCE said they were the only utility that did not seek a change in its authorized ROE. Summary: On April 15, 1999, the Office of Ratepayer Advocates ("ORA") conveyed oral ex parte communications to Commissioner Duque and advisors Dorothy Duda and Michelle Cooke. Commissioner Duque initiated the meeting by written invitation. Other parties attending were Pacific Gas & Electric Co., Sempra Energy, The Utility Reform Network ("TURN"), and Southern California Edison. The meeting was initiated to discuss the proposed decision ("PD") and alternate decision ("AD"). Speaking on behalf of ORA was Steve Linsey. Mr. Linsey expressed ORA's disappointment with the reasoning and result of the PD, and ORA's more adamant opposition to the AD. The Commission's original purpose to unbundle the cost of capital has been misdirected he said. Providing details, he also said both decisions misinterpreted and violated constitutional requirements of Hope and Bluefield. Mr. Linsey said that the PD moderated interest rate changes twice, to reach an unreasonably high ROE. He further said the AD violates the principle that "a deal is a deal." Wesley Lujan and Valerie Justice from RCRC told President Bilas their organization was concerned about water supplies for their member counties and the state with regard to hydroelectric assets currently held by Pacific Gas & Electric Co. ("PG&E"). Mr. Lujan said appraisal valuation proceedings are important to rural counties, and that the outcome of those proceedings have an impact on the property tax base in small rural counties. He said appraisal proceedings help determine and raise questions on details and facts related to the PG&E hydroelectric system. Ms Justice added that divestiture of these assets also have impact on these counties. Mr. Lujan concluded by noting SB 797, SB 1063, and SB 1183 are related to the valuation and divestiture of PG&E assets. Summary: On April 16, 1999, Pacific Gas & Electric Co. ("PG&E") initiated an ex parte meeting at CPUC with David Gamson, advisor to Commissioner Neeper. Commissioner Duque. The PG&E representatives initiating the communication were Jana Corey, Veronica Andrews, and William Manheim. Mr. Manheim stated PG&E's understanding that Enron does not oppose recovery of settlement costs, but does care about who will pay for the costs. He noted all three (3) proposed decisions state that restructuring implementation costs should be borne by all customers, not just bundled customers. Based on various "reply" briefs noted, Mr. Manheim then referred to the six (6) categories in Enron's functionalization proposal in which to allocate restructuring related costs. Ms Andrews stated if some costs are assigned only to bundled customers, then other costs would likely be assigned to direct access customers as well. Mr. Mannheim concluded by referring to the settlement agreement's provision that ongoing 1999 costs will be booked to the Electric Restructuring Cost Account ("ERCA"). He said the issue of whether "procurement" costs should be paid by direct access customers has been considered in the RAP proceeding or in the 1999 ERCA proceeding for 1999 costs.
