Summary: On April 27, 1999 Southern California Edison Co. ("SCE") initiated an ex parte meeting at CPUC with staff of Commission President Bilas. The sole SCE representative was John P. Hughes, and he was joined by the Office of Ratepayer Advocates' ("ORA") representatives Gil Infante and Steve Linsey. The Notice of Ex Parte Communications indicated the filing was a joint filing by both SCE and ORA. President Bilas' staff members receiving the oral and written ex parte communications were Dorothy Duda and Julie Halligan. The subject of the meeting was the proposed decision ("PD") by Administrative Law Judge Minkin. Mr. Hughes said the PD on pp. 53-54 erred in concluding that expensing capital costs "is consistent with both tax and accounting practices and guidelines." Mr. Hughes explained why SCE thought that incorrect. He said SCE could be subject to a severe IRS penalty if the utility violated the normalization requirements of the Internal Revenue Code ("IRC") in that manner. He then discussed the difference between IRS treatment of internally developed software costs and externally developed software costs. Mr. Infante of ORA then discussed possible normalization violations that could occur if computer hardware costs were not normalized per IRC § 168. Mr. Infante, after citing certain distinctions between expensing and depreciation, proposed SCE be permitted to create a memorandum account to tract the timing differences which would occur if the Commission decided to proceed with the one year write-off of computer hardware for ratemaking. He said SCE must avoid a normalization violation at all costs. The written ex parte communications consisted of excerpted pages from the PD and SCE's comments thereon.
