The 4/28/99 brief was filed with the First District Court of Appeal after the Ventura County Superior Court sustained defendants' demurrer without leave to amend. The Superior Court dismissed plaintiff's suit after the four water company defendants demurred on the basis the Commission had exclusive jurisdiction over the subject matter. The underlying lawsuit concerned the relationship between personal injury and safe drinking water standards.
