The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. Summary: On May 6, 1999 Pacific Bell's ("PacBell") Dan Jacobsen telephoned Lester Wong to explain that a CPUC decision to deny reciprocal compensation on Internet traffic would have no impact on end user customers. Mr. Wong is an advisor to Commission President Bilas. Mr. Jacobsen said such a decision would merely end a windfall profit that Pac- West expects to earn from PacBell. In regard to Pac-West's suggestion that PacBell may need to increase local exchange rates to cover reciprocal compensation payments, Mr. Jacobsen said a decision to deny reciprocal compensation would also avoid the basic rate increase that Pac-West described during the hearings. Mr. Jacobsen concluded by stating this arbitration case is the correct forum to eliminate reciprocal compensation on this prospective interconnection agreement. Summary: In ex parte meetings over three (3) days, Sempra Energy ("Sempra") urged PUC officials to adopt Commissioner Neeper's alternate decision rather than the revised proposed decision ("PD"). Commissioner Neeper was present as Sempra conveyed this information on May 10, 1999 during the meeting which was held at CPUC. Earlier, on May 6 and 7, respectively, Sempra met at CPUC with (1) Dorothy Duda and Julie Halligan, advisors to Commission President Bilas, and (2) Michelle Cooke, advisor to Commissioner Duque. The Office of Ratepayer Advocates ("ORA") was also represented at each meeting by Jonathan Bromson. The Sempra representative conveying the communications in each meeting was Claudine Swartz. Joining her for the May 10 meeting was Lynn Van Wagenen of San Diego Gas & Electric Co. ("SDG&E"). In each meeting, Ms Swartz said the revised PD imposes aspects of the PG&E settlement on the SDG&E settlement, and that such an imposition would effectively unravel the agreement. She said the reasonableness of 1999-2000 Section 376 costs was resolved with the SDG&E settlement and that there is no reason to litigate this issue. She concluding by stating it would be unlikely that parties would accept this condition, as it is an integral part of the settlement in which all parties comprised to arrive at a reasonable outcome. Sempra reported that Mr. Bromson explained that 1999 and 2000 costs were originally removed from the PG&E settlement because they were litigated in the PG&E general rate case, and that he further reported reasonableness reviews are an anachronism. Summary: On May 6, 1999, NextLink California ("NextLink") and the ICG Telecom Group, Inc. ("ICG") told Commissioners Neeper and Duque in separate ex parte meetings that PUC should require rigorous third party testing of Pacific Bell's ("PacBell") OSS ("operations support system") test plan and reject the internal testing plan proposed by PacBell. NextLink and ICG jointly initiated the meetings held at CPUC. NextLink was represented by Karen M. Potkul and Melissa Waksman. Mr. Nick Selby, outside counsel for NextLink and ICG, also attended. Ms Potkuk said there were problems with PacBell's LEX electronic ordering interface, and she cited related examples to illustrate the need for thorough OSS testing in order to achieve improvements required by CLEC's ("competitive local exchange carriers"). Ms Waksman cited Federal Communications Commission ("FCC") decisions indicating internal OSS testing by PacBell would be scrutinized carefully by FCC. The filers stated their involvement in the draft application had been aimed at improving PacBell's OSS because it was essential to NextLink's and ICG's ability to compete as CLEC's. Ms Potkul stated their were problems with the proposal that would require local exchange carriers to migrate customers within 30 days of a letter of authorization ("LOA"). She said that is because facilities based competitive local exchange carriers ("CLEC's) need a long period of time to migrate customers to their services. Tasks in doing that are time consuming she said. Ms Potkul contrasted that with the automatic process by which primary interexchange carrier ("PIC") changes are accomplished for interexchange carriers ("IEC's"). Summary: On May 6, 1999 Pacific Gas & Electric Co. ("PG&E") told Commissioner Duque's advisor, Michelle Cooke, that the utility appreciated the proposed decision's ("PD") grant of extension of time for implementing the weekly average PX pricing. However the utility added that the PD's criticism of PG&E's billing system management for the last twelve (12) years was unwarranted and unsupported. In the meeting at CPUC initiated by PG&E's Jana Corey and Andrew Niven, they stated the complexity of PG&E's billing system was not fundamental to the grant of an extension of time, and that the issue is being considered in another proceeding. Mr. Niven stated PG&E might have prepared different testimony for the 11/13/98 hearing if the utility had known that a reasonableness review of the billing system was going to be addressed. He noted the original purpose of the hearing was only to address the need of an extension. He concluded by stating there is no legal basis for a reasonableness review and possible penalty absent a violation of law or Commission rule. Summary: On May 6, 1999 Pacific Gas & Electric Co. ("PG&E") told David Gamson the proposed decision ("PD") is fair and reasonable. Mr. Gamson is Commissioner Neeper's advisor. PG&E representatives Sabrina Miller and Jennifer Post initiated the ex parte meeting held at CPUC. Ms Miller stated that until PG&E is no lo9nger the default provider of bundled service for customers who choose to switch back from a competitive energy provider to the utility, PG&E must keep the infrastructure in place to serve such customers, and therefore cannot avoid the costs associated such customers. Ms Post stated a PX credit based on fully embedded costs results in inefficient energy markets because an inefficient competitor with costs greater than PG&E's avoided cost, but less than the PX credit, can price in between and gain market share.
