PG&E said they did make adjustments on estimated gas usage for the unoccupied buildings as if they were occupied. PG&E then provided Ms Cooke three (3) reasons why a Title 24 standard was the incorrect standard to apply to the Presidio buildings. The PT representative agreed, and also said Title 24 takes into account thermal loads, not distribution loads which were the target of the Power Savings Partner ("PSP") gas conservation project. The NPS representative stated that but for the energy savings payments generated by the PSP project with PG&E, the Letterman boiler project and subsequent distribution loss savings would not have occurred after NPS assumed jurisdiction at the Presidio Letterman site, and that these savings were continuing to support energy conservation. Mr. Niven stated PG&E might have prepared different testimony for the 11/13/98 hearing if the utility had known that a reasonableness review of the billing system was going to be addressed. He noted the original purpose of the hearing was only to address the need of an extension. He concluded by stating there is no legal basis for a reasonableness review and possible penalty absent a violation of law or Commission rule.
