Summary: On May 10, 1999 Enron Corp.("Enron") told Commission President Bilas the proposed decision ("PD") issued by Administrative Law Judge Malcolm provided no relief to the electric service provider community. Enron said the PD erred in adopting an avoided cost approach for determining which costs should be reflected in the PX credit. The issue, Enron said, is not which costs are avoided, but what costs are incurred by the UDC to provide procurement service to bundled service customers. The latter, Enron said, are costs which must be recovered through Schedule PX (and thus reflected in the PX credit). The ex parte communication occurred during a meeting at CPUC initiated by Enron. Representing Enron were Sue Mara and Jeanne Bennett. Gary Ackerman and Daniel Douglas of the Western Power Trading Forum ("WPTF") accompanied the Enron contingent. Before departing, both Enron and WPTF proposed various options the Commission could utilize to place additional procurement costs in the PX credit and still adhere to the record in the proceeding.
